alicia98981. Please I have question for you when you cheek the website what say it still show approved or transfer to NVC ??

For us we get approved November 19 and it still say case approved

Ours never changed from approved and was received and shipped from NVC just yesterday. I have read from others also that their status never changed. The only sure way is to call NVC, I always called right at 7AM EST and only had an average of 10 minutes wait.

CSC doesn't change your status after approval, but TSC does once it has shipped to NVC.

At least that's how it is most of the time it seems.

I called the NVC again this morning and finally spoke to someone who at least seemed honest and sympathetic.

He said it can take nearly 70 days for the NVC to get the petition from the USCIS, log it into their systems, and begin to process it. But, he said they ought to have record of having received it by half that time at the latest.

He seemed concerned that they don't have record of it since our NOA2 was dated Oct 2. He said it definitely needs to be researched. I did email them on Nov 16 and sent a scan of my NOA2 on Nov 21, but unfortunately, I sent it to nvc Inquiry instead of nvc Research. :( I remedied that this morning.

The NVC representative told me that he can't give an idea of how long the research could take as they're processed in the order received and some can be researched in ten minutes while others can take a researcher several days to figure out what happened. He said if it truly can't be found, the NVC will request the USCIS send it again.

Ok, part 2... I called the USCIS again and spoke to another unhelpful person who gave me the 90 day story again. When I asked for a tier 2 person, he said I can't put in a service request to resend my petition to the NVC or speak to a tier 2 person until the 90 days are up.

I asked him what will happen if my NOA2 expires before the NVC receives it. (90 days + service request processing time + up to 90 more days?) He didn't seem to understand what I meant and said my fiance will have to contact the consulate or the state department with a request for an extension if we feel there was a legitimate reason for them to grant us one.

So... that's where we stand right now I guess. 60 days out from the approved NOA2, no one knows where our petition is and the USCIS won't lift a finger until January. Where's my vodka?

Just call and call and call until you get someone who is willing to pass you onto a tier 2 person. Once you get past that initial barrier, the tier 2 person should be more helpful. I know it sucks, but that's all you can do at this point. That and get a congressional office involved.

A few things ...

1. I don't think it matters whether you email NVC inquiry or NVC research. It all ends up in the same processing. I sent my email on Oct. 29 and they just replied to me today.

2. The 90-day thing is baloney. It sounds to me like they started handing out this story with the executive order on illegal immigrants. And it's ca-rap. Call again. And again. Until someone puts you through to a Tier 2 and lets you put in a service request. You should be able to put in a serve request after the standard NVC wait times ... four to five weeks, 35 days, 42 days, whichever bullet point they pick on any given day.

3. Pass the vodka, please.

bandi77, this is the advice I gave to someone else and it worked for them:

Hmm.. The first time I put in a service request, I told the tier 1 person that it had been more than 30 days and that NVC had put in its own service request to get the NOA2. The 2nd time I just mentioned how my service request answer was pointless and dumb, so could I talk to a tier 2 person to complain about it.

Perhaps others have better advice, but I would recommend a) repeating that your NOA2 says NVC should have it within 30 days, and that NVC has confirmed to you via both phone and e-mail they still don't have it. It's long past 30 days. b) You were previously told that once it passed that mark you could put in a service request (that might be a lie, but hey, they're BSing you, so you should do the same) c) if they're still putting up a wall, just tell them you're going to call them over and over again until you get a hold of someone who can actually help you.

And honestly, that's what you gotta do: just call over and over until you get a helpful person. I noticed the more forceful (but not rude) I sounded, the more they'd try to do something.

Given the response I've received from the Tier 2 people, it seems clear the first level people don't know what they're talking about. No Tier 2 person ever said 90 days to me, just the first level drones.

Thank you for the encouragement! I'll keep trying. I consistently get the feeling from the uscis that they would make up a story on the spot to make me go away. It feels like a game of wills to see just how much of a thorn in their side I'm willing to be until they take notice and do something. How tiresome.

Thank you all for the info and company! My fiancé called today (Tuesday) and we got our case number and it had been sent to consulate earlier today! noa2 date November 3rd and sent to NVC on November 10 from TSC. Now to wait for interview to be scheduled... Probably around March...
