I'm actually headed to see my fiancee in about 10 days and will be with her for 3 weeks. We were originally hoping way back in freaking early April that I'd be going over there and coming back with her on this trip. When we got the NOA2 in September, I thought our plans were right on schedule. Thanks USCIS for ruining that.

And while I am with her, I really won't have the time to follow up with these dumb agencies.

One more suggestion: schedule an appointment with your local USCIS office (infopass). I am scheduled for Friday, December 5th (the day I actually leave to see my fiancee). I couldn't get an earlier appointment, all other time slots until then were filled- crazy. No idea if this will be beneficial but I figured it was worth a shot.

Well, I'm with you wanting to cry my eyes out. I called USCIS today and was told to wait 90 days from the date of the NOA2 before calling the NVC or asking the USCIS for further action. Well, I will keep calling and contact my congressional office too but this is unbelievably discouraging. I had hoped just a month ago that he could be here by January. Now they're saying to wait that long just for the NVC to receive it. And then if it's lost, to wait another 90 days for it to be resent to the NVC, or maybe longer if we get stuck at the USCIS when they start processing immigration reform applicants? what a nightmare.

I can't wait another three months. My unemployment insurance runs out soon.

reading some previous similar posts, I saw that in many cases like ours USCIS sent petitions to NRC instead of NVC .

I couldn't though identity how did those petitioners knew that their cases were sent to NRC instead.

Any tips?

From what I gathered when reading those posts, those people took the same steps we did and eventually USCIS reveled that info. Sometimes it was through direct communication with USCIS and sometimes it was through NVC contacting USCIS on the petitioner's behalf. I have a hunch that the same is going to happen to at least a few of us...

National Records Center. CSC has a history of incorrectly sending petitions to NRC instead of NVC. Someone said that all old immigration records go to the NRC, hence the high chance of a mistake like this happening. Obviously the easy solution would be to change the name of the NRC or NVC so a mix-up like that would be a lot less frequent. Of course the NRC and NVC are parts of two different agencies, so that change is never going to happen... :sigh:

I wish I couldn't happen with us. For me, I have the expire Noa2 in January. If I couldn't get the case number before that, what I can do next? Will anyone have responsibility to extend the date for it, or take care of our cases?

From what I've read, if NVC gets the NOA2 after the expiration date, NVC will send it back to USCIS to get it re-approved. It will slow things up another 3-4 weeks if that were to happen. If NVC gets the NOA2 BEFORE the expiration date, then the NOA2 expiration date can be easily extended by the embassy.

Thank you so so much. It makes me feel better now. The only thing we can do just wait I think and see how it's going on. Please update the news from them. I will do it too. Don't give up guys. <3 Edited by Tuktawiparat

I was reading that the NOA2 is good for 4 months but once u pay the Embassy fee its good for a year. But it's not right when we have no control over the issue. There should be some kind of exception. Sorry for all the problems everyone is going thru. Hope everything gets straighted out soon. Praying for all.

I'm not feeling very confident about this whole situation. If none of our cases get to the NVC before Christmas I don't think it will get there before the expiration date, assuming our expiration dates are in January

But it does say this in the service request response email... "Please note, if necessary, the current priority date assigned can be reset by the consulate at the time of interview."

OK, kids ... my fiance called CIS again this morning and spoke to a Tier 2 IO. Here's what he said she said:

The good news is that you were right. Our file was sent to the National Record

Facility and California Service Center has asked for the file to be reviewed there.

The bad news is this is where the 30-day period comes in. The 30-day period is for

them to find the record and ship it to the NVC. The lady I spoke to told me that if

I haven't received a case number by December 19th (I'd get this via mail) that I need

to call in and escalate to tier 2 again and ask them to expedite it because

our approval is getting close to expiration and it's an emergency.

Thanks for the info. I just hope that USCIS does that "review" for all of us in this predicament. Maybe I should look into how I can cheaply call the NVC when abroad..

I wish they could be more forthcoming with information. They're playing with our lives here.

We also just heard from our congressman. They are going to intervene and request expedition.

But that could take up to four weeks.
