Thanks for the information..let me refresh it.. So it means I will be interview here in hongkong and my children will be interview in Manila? We were deciding that I will come first in my fiancée country and let my children follow...

Hi..I am new here. My american fiancee would like to apply a k1 visa for me. We are trying to meet the requirements. I am from philippines but recently working in hongkong. My fiancee would like to process his petition while I am working in hongkong. Would that be possible? We also like to include my children in my petition however my children lives in the Philippines.. How can we make it happen? Help us out...

There is no issue doing the I-129F petition process with you being in Hong Kong and your children being in the Phils, there is a section on the I-129F, page 3, to list the children.

If you are going to be processing your visa in HK make sure to use your address in HK in part 2 section 3 (NVC will go by this address when determining which embassy to send the case file to, NVC does not bother to look at part 2, section 36).

A family member can assist the children through the process in Manila. It may be good to get a power of attorney to this person.

If you plan to fly back to the Phils to complete the visa application DO NOT put your Hong Kong address in Part 2, section 3 ... put your home address in the Philippines there.

Not sure how it is done in Hong Kong, but in the Philippines you schedule your own (in this case for your childern) interview date online.

your interview will takes place in Manila with your children. And yes you will be interviewed all together :no:

NO! If she is doing her processing in Hong Kong that is where her interview will be, her children will process through Manila with their own interview date.

How would I know if my fiancee mets his income statement in applying visa for us?

Your fiance's income must meet the 125% poverty guidelines of the I-864P (there is a link to this from my link below in my signature)

He will need to have income for you and your children, himself and if he has children in the USA they must be included also.

If our application is receive, how long usually do we have to wait for a schedule interview?

Once NVC gives your fiance the case the case file number and your case file has been forwarded to the embassy, for Manila you are in control of scheduling the interview date. I am not sure how the embassy in HK does this, you need to access the embassy instructions letter for HK (I am sure it is on their website) as they may assign the interview or you may be scheduling your own interview - each embassy has their own way of doing things.

the final verdict will be during your interview. The consul will be the one to say if your requirement meet the guidelines. But most k1 visas are approvedanywas so no need to worry ? The most important thing to bring is your fiances ITR AND W2. recent ones.

All required documents and forms are listed in the embassy instructions letter from the embassy doing the application.

Hello, I'm also from the Philippines and my fiancé just recently filed K1 petition. Upon checking on my WAC# at the USCIS web site, it indicates that the petition is on initial review as of september 9. 2014. My question is how long usually it takes to received the NOA1 and NOA2? And my when my fiancé filed the petition he have not yet send the I-130. Is the USCIS will request for it before I received my NOA2? Or it will be during my interview?

No issue doing follow to join, just make sure to start the process early enough so that the K2 visa is issued before the date your visa was issued.

Minor children who are identified and listed in the approved I-129F petition may follow-to-join their petitioned
parent. However, such follow-to-join K2 visas can only be issued within one year from the time the parent
was issued the K1 visa. After one (1) year, they will no longer be able to derive immigration benefits from the
I-129F petition and you or your spouse will have to file an immediate relative or second preference petition for
them to qualify again for immigration benefits.

I am going through this process right now. I applied for my wife in her location, and our daughter (filipina) in the Philippines. The only part they questioned was if I wanted to make both in my wife's location or like it is currently scheduled. I responded with keeping my wife in her location, and my daughter in hers. I told them to please schedule it so we could interview my wife, and then she could fly to Manila to meet our daughter and process hers the rest of the way. There was no problem they said. I am waiting right now for her interview, and my daughters is still to be scheduled.

Yes, there is no problem with your filing while you are in Hong Kong. My (now) wife is a Filipina and we met and were engaged in the United Arab Emirates. Be prepared for your K1 visa petition to take a little longer than others, because they apparently need to investigate both for Hong Kong and for the Philippines. My wife was interviewed in the United Arab Emirates, but we did not petition for her children as they are all over 21. As for where you will be interviewed, I would just let USCIS tell you where to be interviewed. If you must have your children present for the interview, then likely you will have to be interviewed in the Philippines. If that is problematic, you could file only for yourself and then file a petition for your children once you are in the USA. I know that would increase the separation time from your children, but you will have to figure that out for yourself. Personally, if it was me, I would include children on my K1 petition as it simplifies paperwork and would keep children with parent. Good luck! My wife and I are very happy now that we're together, so it's worth it.

They will base it on the beneficiary's mailing address and the consulate that is listed as the one you will apply at on the I-129F. They are legally residing in HK, so they can interview there. The children must be listed on the I-129F to be able to follow-to-join with a derivative K-2 within a year of the K-1 being issued. The children can interview and receive their visas separately from the K-1 parent, in Manila, as long as it is within a year of the K-1 issuance. This was already stated a few times in this thread.

Hello everyone.... I need your opinion on my condition. I have been working in hongkong and planned to stop working and go home in the Philippines. My fiancee would like to file a k1/k2 visa for me including my children. I decided to stop working because we will file the visa in Philippines. What worries me is my police clearance? I have heard it is needed for me to get one. Do I need to get a police clearance in hongkong before I leave on this place?

Yup,i think u need to bring home police clearance because they said if u leave for more than 6months....

I am filipina too and working for k1 visa

Im waiting our papers to transfer from phils.to hk....

Hi Cheng... Why do you need to transfer your papers in hongkong? Was your fiancee in hongkong? I have heard that police clearance won't release unless I have a notification from the consulate..i havent started our application yet...it will start when i will be in the philippinea
