Hi all,

I have a quick question hopefully someone might have had some experience with. I'm a British Citizen and am currently in the US on a K1 (got married a few days ago!)

I haven't applied yet for the AOS/parole to leave the US - but does travelling over the border to Montreal and back again the following day count as leaving the US?

While I know that might sound like a strange question, but I wonder if it might be possible because on some US visas going to Canada doesn't count as leaving.

Many thanks in advance if anyone knows about this.

If you leave the country without first receiving AP or your green card, then you will abandon your eligibility to file for AOS, or would abandon your AOS process if you had filed already. You would then need to start a whole new visa process and file for a spousal visa to return to the US.

I am going to be facing the same scenario, My fiance and I are projecting for a march 2015 wedding, yes, i know, it is too early to make any plans and dream up things, but we are hopeful that the 9 month time frame from when we applied to when we get married works (God willing). My younger brother is getting married in Toronto, Canada a month after we get married, now i understand that my fiance will not be able to cross the border to go to Toronto, but there there a way to get an expedited AP? in order to do this. I am not trying to steal away from the OP, may be a response or two to my question may help the OP as well?

You can get the AP expedited for an emergency situation. Attending a wedding does not meet that criteria. http://www.uscis.gov/green-card/green-card-processes-and-procedures/travel-documents/emergency-travel

You could go to a courthouse and get officially married as soon as you arrive in the US, so that you get your marriage certificate and can file for AOS, EAD and AP, then you should receive your EAD/AP within 60-90 days. Then for your "wedding" just do the ceremony, reception etc.
