hello,

just submitted our paperwork for i-751 lifting conditions of status. several questions

1. How long has been the process for those who have done this? i know it says it can take up to an year but curious about the backlog currently.

2. How often is there an interview or does the examiner just look at the information and approve it.

My son sent in his in May and got a 1-yr extension letter without even a biometrics date. Another friend did the same and received biometrics date but still did not receive any other status update. Two days before her GC would have expired she went to the Application Support Center and they gave her a 1 year extension.

Interview depends on the case. If the ISO thinks that after two years there is no significant amount of ties to indicate that the marriage is authentic, they can chose to interview.

Good questions. Suggest that you review current ROC forum threads for possible answers to questions that many of your fellow ROC petitioners already currently ponder....

1. It depends on which service center your petition was sent to. Currently California is much faster than Vermont. On average, California is taking 4 months, Vermont 7-8 months. However this could change by the time your applicant is processed.

2. Generally, if there is insufficient evidence sent with the initial application, an RFE is sent requesting more evidence of a good faith marriage. If the applicant fails to respond with enough evidence to satisfy the reviewer, an interview is scheduled. Interviews appear to be uncommon for ROC, however.
