Hi,

So I'm a bit nervous, my GC is expiring pretty soon and my wife and I simply don't have anybody that could vouch for us. We have neighbors that we rarely see and I've never talked to any of my wife's colleagues other than a quick "hello". My wife has a good friend in our apartment community where we have been living for a year, but I haven't met her so far.

So far, since I moved to the US, we have pretty much kept to ourselves, we are outdoors people and we don't go out much where we can meet people (like bars). We are fine with that and we had no idea it could be a problem for the ROC.

Also, in case you are wondering, we have only one family member who is a US resident and could testify for us. The i751 instructions says you need at least two people.

Here are our evidence:

- lease of our apartment

- utility bills with my name, and other utility bills with her name (how many should we provide? Every months or just a few over the last two years?)

- health insurance cards (we are on the same plan and we have the same PCP)

- one hospital bill with my name (as patient) and her name (as health insurance subscriber)

- our driver's licences showing we have the same address

- geico car insurance card showing both our names for the same car (same question: should we provide one recent, one old, or all of them?)

- a few pictures taken over the last two years, with or without family but all of them are close to home (so we don't have any travel documents, hotel reservations)

We don't have anything else.

I appreciate any comment,

Thank you very much!

Hi,

Affidavits aren't required, they are optional. They also have the least weight in your decision. The evidence you have is ok, however there are additional things you may use.

Joint taxes(you have to have these), joint bank accounts, joint car title, joint car registration, beneficiary on a life insurance policy of the other, joint health insurance (it has to be the same policy, not the same company if you use this as proof), gifts to each other, mail addressed to the both of you.

Basically anything that could prove you keep a house together and share a life, so a receipt that you paid for the broken water heater and she paid for the broken water pipe for example. Also, it's best if the evidence covers the period after your marriage or after you moved in together. You could never have too much evidence. Good luck.

This does not constitute legal advice.

You really need to get several people that at least know that you and your spouse live together in the same home. It does not have to be both spouses friends. They just need to have knowledge of both of you as a couple and can say how they know at least one of them and met the other on at least one occasion. I am sure that your situation is not unique.

My impression is that if you were lacking in other evidence that you lived together or spent time together, affidavits might be useful. But they are not going to penalize you because you aren't social butterflies. Did you spend time with your wife's family? That might be more indicative than friends or neighbors anyway.

Thanks guys for your comments!

Yes tuckin14, my mother in law visits us several times a year, coming from another state. My family came to the US to visit us once. I do have pictures of us with my family or hers, I will definitely use them.

I have a couple of pictures of us where you can clearly see when it was taken (for example, one photo of us is in front of the Washington Monument when it was being repaired in 2013). I also have some pictures where I grew a beard and some where I look thinner.

I wonder if the USCIS pay attention to these kinds of details? Of course photos can be faked, or staged...

I also have pictures of my wife and I at the same location but taken separately (she would take a picture of me, I would take a picture of her, but we don't have a picture of us together). Can we use those?

How many pictures should we include? So far I selected about 15.

Unfortunately we don't have most of the documents you are suggesting to use (joint accounts, car title, life insurance, etc). But I read on several other topics people suggesting to write down why certain types of documents are not included in the package, to avoid a RFE (for example, saying the obvious: "We are not including any life insurance policy because we don't have one"). So I was thinking of doing that too, in our cover letter.

We do have joint health insurance.

We are going to look into the irs.gov website, see if there anything we can download.

I have tons of letters from my family but it is not written in english, I can always make copies of the envelopes since you can clearly see where the mail came from, and that it was sent to both of us. Do you guys think it is really useful? I was thinking I would only use them if I have to go to an interview.

The evidence you have should be enough (did you really not file joint income taxes?). Are you two on the same car insurance policy? You could use that one too.

Thanks guys, I actually filed my petition a few weeks ago, with 10 pictures (taken with and without family). I haven't received any RFE so far, so I think I provided enough evidence.

Yes, we did file joint income tax. Actually, if anyone reads this, you can get tax return transcripts on the IRS website http://www.irs.gov/Individuals/Get-Transcript

When I get my green card, I will post the list of the documents I included as evidence. For anyone interested, I will post them here: http://www.visajourney.com/forums/topic/501148-i-751-september-2014-filers/

I never sent any affidavit and didn't get a RFE. I think you have enough proof. I had everything you can imagine ( mortgage together, car in both names, tax, joint account, baby on the way, health, life and all benefits possible in each other's names etc...)
