Hi everyone, I've been following your good news and updates and I really wish that I'd be sharing my own good news right now but alas, it is not so.

After no case status changes online since October 2014, I sent a case inquiry online on August 10, 2015. Today, August 21, 2015, I received a physical letter dated 8/17/15 in response to my inquiry. According to the letter, USCIS sent RFE on 8/3/15 to my attorney (who hasn't contacted me about this RFE, IF their firm did receive the request). I always got a copy from USCIS of any Notice of Actions that my attorney received also, so I don't understand why i didn't get the RFE as well. My address hasn't changed since filing ROC so I don't get it. 2 and 1/2 weeks since RFE and nothing in the mail NOR any case status changes online UNTIL I requested an inquiry?! Ridiculous! Oh and my status online is still the same from October 2014.

They sent me a copy of the RFE that should've been sent to me and i have until 10/29/15 to respond. I feel like it's going to be much harder to give more evidence because unfortunately since AFTER filing ROC last October my husband's been in jail still awaiting trial. I really haven't had to use our joint bank account since I'm the only one working now and I've been depositing my checks to my personal account. Obviously we're not cohabitating for almost a year now and we've been staying with my parents even since before he was put in jail, so no lease in both our names. I had to file single this past tax year but my attorney had told me that we just need to explain the situation regarding my husband's current status , being that he's in jail. I still visit my husband in jail in PA (we live in NJ) driving 3 hrs round trip once every 4-6 weeks, constantly put money in his commissary account so he can survive, and so that we can talk on the expensive prison phone system. We also write to each other (him more than me since he has more time to spare and reflect). I'm wondering if copies of our letters, receipts of my deposits to his commissary, would be enough to show that even though we're apart we definitely ARE and STILL husband and wife.

I was afraid of this happening but also had a feeling that it would because it seems like bad luck always surrounds me. Sorry to be so negative right now; I'm just feeling so overwhelmed by, first and foremost, my husband & his situation, work stress, health stress(diabetes, then my gout decided to flare up today, just great), and now this. I just want to break down and give up!

Anyway, I'm sorry, i have noone to vent to at the moment and i can't call my husband because with the phone system he has to be the one to call me, i have no control over it. I just wanted to give update so someone could update the list dates info but i babbled on and on. Could somebody please update my RFE info? I'd really appreciate it, thanks! Some prayers and good luck too? :)

Sorry about your RFE, but most definitely explain your situation in a letter. Send copies from your husbands letters and show them the account you have been depositing money into. Tell them that since he is in jail you have been living with your parents and I don't know what kind of proof you can get to show them that he is actually in jail, but do that. I don't know if you can get prison logs of the visitors your husband had, but if you can do that as well.

Hi everyone,

Happy to see that Vermont list is almost completed. So my husband completed the I-751 earlier this year and a few weeks ago we submitted an application for my mother-in-law to visit us in the US. She was approved within minutes of the interview. She was asked 2 questions and that was it. We sent evidence but they didn't look at any of it. She's been a housewife most of her adult life. So I know people say most of the time that the person who apply for a visa must do it on their own merit but I don't think that's true everywhere. So if you're in doubt of trying to bring a parent over for a visit, just do. Follow the steps and do it. It may be the easiest thing you do :). They asked who was paying for the trip and she replied, "My son." That was the second question and that was it.

I have been waiting for the day that I would be able to add my approval date to this list and today is that day! RFE documents sent 10/22?/15. Interview notice 12/22/15 for interview date of 1/7/16 at 7AM.

Husband is still awaiting trial in jail so could not attend interview, which I was worried about because the interview notice said BOTH need to be present or else petition may be denied. I went with my lawyer, with a letter from husband's lawyer confirming why he couldn't be there today. My lawyer told me yesterday it could go either one of two ways: the officer may put my case on hold due to husband's case still pending, OR the officer could go ahead with the interview. Option #2 was what happened today and after the very nice officer interviewed me and listened to me, had to speak with a higher-up personnel on what to do with my case. I asked to go to the bathroom at this time while he spoke with his boss and I snuck in an extra prayer before he called me back in to the office. Then he said that from everything he heard today, there was nothing to indicate that it wasn't a bona fide marriage, so he was going to waive my husband's presence and approve me. He will just need to do a file review, which my lawyer said is just checking my background to see if I have any arrests, etc., and that I should be receiving my new GC within 1 month but probably less than that.

It was so worth only sleeping for 3 hours last night! I'm just so glad this situation is over and there's one less burden off our shoulders! Finally some peace of mind and freedom! :joy:

To anybody still waiting, keep holding on to hope! The officer didn't even ask me about my single status tax return for 2014 or joint accounts, insurances, etc. I think it's good to have as much evidence as you can, but a lot of the decision I think is based on the couple's answers and reactions as well. :crying: <--- Tears of joy!

I had my interview today 1/8/16 at 10:30 at the Atlanta office. The questions she asked were basically from what I filled out on the form i751. Then ask for any new stuff for 2015 I gave her those. She told me my documents were sufficient and few mins later I got an approval etter. Finally after over a year of waiting I can rest at ease. Thanks to everyone for their support n sharing their experience.

08/12/2013 - Concurrent filing of I-130/I-485/I-765/I-131 sent.
08/15/2013 - Delivered to USCIS Chicago Lockbox
08/20/2013 - Acceptance Confirmation text messages (4) and emails (4).
08/21/2013 - Check cashed.
08/24/2013 - Four I-797C notice of action in mail.
08/26/2013 - I-797C for Biometrics notice. Appointment scheduled on 09/16
09/07/2013 - I-485 case status updated to RFE and the RFE notice mailed out.
09/16/2013 - biometric appointment
10/16/2013 - Received Email/SMS about I-765 EAD Production Ordered. Nochanges in I-131 AP status
10/21/2013 - Received Second Email/ SMS about I-765 EAD Production Ordered
10/24/2013 - Received Third Email/ SMS about I-765 EAD mailed to address.
10/24/2013 - Received Fourth Email/SMS about I-765 EAD approved. Case status is back to Post Decision Activity

10/26/2013 - Received combo card in mail

10/28/2013 - I-485 case status changed to Testing and Interview

10/31/2013 - Received Email with interview date 12/05

12/05/2013 - Approved on the spot during Interview:)
