Hi Everyone,

I'm looking at the I-864 form and I'm a bit confused.

I know I need to check the box (#25) that says I've filed tax returns for the last three years but am only including this years.

The problem is, I'm only filing for this year because I was working under the table in Italy the previous two years.

I didn't file in Italy, obviously, because I was working under the table.

My dad will be a joint sponsor so it's not an issue of exceeding the poverty line.

Hopefully someone will help me!

How would they know? But immigrations will want to know why you had no income. Depending on your age, employment history, etc. Also if you stayed out of the country long enough you won't need to pay taxes until you exceed eighty something thousand dollars. Like I said...depends on the facts.

Seems to me you have 2 choices here;

1) Like t says, you should file your back taxes. There could be a penalty of some sort.

2) you can "pretend" you earned nothing during those years. If you were to take that approach then you would need to include a written explanation as to why you did not file. Take into consideration you are certifying too the truthfulness of your statements/proof on the affidavit

Well, I was only earning E700 a month. The form says though that even people working outside of the country aren't exempt from filing taxes. Maybe I would be exempt from filing because my income was low enough.

I thought the I-864 was used only for immigrant visas (CR-1/IR-1) and AOS and that K3 petitioners use the I-134?

2007-04-16: I-485 and I-765 sent to Chicago (My AOS/EAD checklist)

2007-04-17: Received at Chicago

2007-04-23: NOA1 date (both)

2007-05-10: Biometrics appointment (both - Biometrics review)

2007-06-05: AOS interview letter date

2007-06-13: AOS interview letter received in mail

2007-07-03: EAD card production ordered

2007-07-07: EAD card received! (yay!)

2007-08-23: AOS interview (Documents / Interview review)

2007-08-23: Green card production ordered!!!

2007-08-24: Welcome notice mailed!

2007-08-27: Green card production ordered again... ?

2007-08-28: Welcome notice received!

2007-09-01: Green card received!

Done with USCIS until May 23, 2009!

oh, i don't know, i was under the impression that it depended on the consulate.

I've tried emailing and calling the consulate but have had no luck.

I got this information under "Embassy Info", but it does not specify which documents are required for each kind of visa.

However, I think this is beside the point.

I'm still going to have to submit tax returns.

I've decided to file back a couple of years.
