Hi everyone,

I just joined VJ and it is so helpful! I am a USC and my husband is a UKC. We submitted the I-130 petition at the start of September to the London USCIS office. I received a notice that payment was taken on September 5th. Can someone please tell me what the processing time is from the date of I-130 filing (payment taken) to interview provided that I submit all required documents and fees without delay?

The reason I am asking is because I currently live in the UK and my ability to show that I have only been "temporarily" away is too weak as I have been away from the US since 2006. Therefore, to meet the domicile requirement to complete the I-864 as the sponsor, I need to find a job and move to the US before his interview. But, we do not want to be apart too long so I only want to move at the latest possible time.

What does the embassy expect me to do after I complete the DS-260? Do they schedule the interview after that?

Because I thought I could file the DS-260 asap and then begin employment in the US (however long that takes) and then prepare the I-864 for my husband to take to the embassy. I am guessing this would mean finding a way to delay the interview until our financial documents are ready.

Please advise!

Thanks!

It is going to take 2-3 months probably. This guide written by a London DCF member of VJ will help lead you through the process. Read it. http://www.visajourney.com/wiki/index.php/DCF_London

If you get a joint sponsor for the I-864, then you wouldn't have to rush to get a job. You can show your INTENT to reestablish domicile, rather than leaving the UK now. I am pretty sure this London FAQ is referenced in the DCF London guide, but read all of it too. http://london.usembassy.gov/faqs-i864.html especially the domicile page to know what they say about merely showing you have intentions to domicile instead of actually moving before your spouse.
