Early Parole timeline

Timeline

Background:

My wife applied for AOS in May, and did biometrics in June. She already has her work authorization card.

This month we received a letter saying that because of the heavy load at the office, it will likely be another 6 months until she can get her green card.

The problem:

Since applying for AOS and work authorization, my wife's grandmother has been diagnosed with Alzheimers, which is worrying, but we didn't think it was serious enough to receive Early Parole for her to go home and visit.

But last night, her aunt was killed by a drunk driver, and I think it's important for her to be able to go mourn with her family. How long does it take for the application to be processed? I don't think she'll be able to attend the funeral, since this was so sudden, but I am hoping she can still get back to China quickly.

2013.1.7- I-129f mailed to Texas Lockbox (with correct fee this time--> Delivered 2013.1.8 (priority date)

Its called Advanced Parole and will take 60 to 90 days typically. We usually advise people to apply for it when they AOS, because of situations just like yours and it costs nothing when applied for with the AOS and EAD. You can still apply free and if you send a copy of the AOS NOA1.

You may want to make an infopass appointment and explain the situation there. I believe they can stamp her passport with a temporary re-entry permit for emergency situations. She may yet make the funeral if you can get in soon enough.

If you are experiencing an extremely urgent situation, you may visit your local office to request an emergency advance parole document. When visiting a local office to request emergency advance parole, you should bring the following items:

  • A completed and signed Form I-131, Application for Travel Document
  • The correct I-131 filing fee
  • Evidence to support the emergency request (e.g. medical documentation, death certificate)
  • Two passport-style photos.

Thanks for the info. We thought about applying for the Advanced Parole, but didn't think she qualified and didn't want to rock the boat. Now that she definitely qualifies, we want to make sure it's done right.

When it says local office, is that the local USCIS office where she got her biometrics done?

2013.1.7- I-129f mailed to Texas Lockbox (with correct fee this time--> Delivered 2013.1.8 (priority date)

They are not the same office. Might be in the same building, but in different offices. For us they're in completely different parts of town. Biometrics (ASC)

offices and your local USCIS office are different things. When you make your infopass appointment online, you should be able to get the address there.

I say , if in 100 mile radius, uscis office to yer house,

drive in without appointment,

telling the guard you need emergency parole and yes, it's an emergency.

re: fingerprints - might get lucky there, there's a digital image already stored for the EAD - remind the IO about it..
