Do we need to sumbit copy of past 3 years W2s along with I-864 Affidavit of Support?

My husband got laid off in 2003 and only made few thousands dollars that year but he got hired back in 2004 till now. He started to make about 40s k annually. Does it matter that he didnt make enough in 2003 and now has a stable income?

Hi,

They got rid of the 3 year requirement and only ask for most recent year tax return. I would send the 1 year with a letter explaining the unemployment in 2003.

They don't ask for the copies of the last 3 years, but they do ask for the Income of the last 3 years...

I'm worried about that too.

You are only required to send the last tax return.

If you think the 2004 and 2003 will help you to qualify, you can send them too.

That is not my case, but we'll still need to state what the income was.

It says in the instructions.

I don't have the number anymore. Just call the IRS general number and they will direct you. When I called; in 2002, they faxed me a tax transcript while I stayed on the line. INS was satisified with the tax transcripts.

There is no requirement to submit W2s. There is a requirement to submit a copy of an income tax return or an IRS tax transcript.

In the case of chosing to submit a tax return, note that a tax return of necessity includes a W2 if there was income earned from employment (unless, perhaps, self-employed).

To get an IRS tax transcript, follow this link. Then search for "0406 Form 4506-T Request for Transcript of Tax Return. In the form, it says "You can also call 1-800-829-1040 to order a transcript. If you need a copy of your return, use Form 4506, Request for Copy of Tax Return. There is a fee to get a copy of your return."
