K1- SS# & EAD info for you

Hi Everyone-

I have some info about our process - I thought it might be useful; particularly since it contradicts info that I received here on this site. Briefly, ny fiance had his POE in Newark on 01/15. No problems. No work permit stamp but was given EAD application. We applied for his SS# with no problem on 01/19 and was told that it would be mailed out in 10 days. Some posts said that you had to wait for 2 weeks to apply. I think it takes them some time to get your info but you can apply anytime with your passport and k1 visa. Second, we completed the online EAD application on 01/17 and sent in the supplementary supporting documents. We already received an appointment on 02/08 to go to the local Boston office and get his EAD card. So, you do not need to wait to send your EAD in with a I-485...,you will need to do another EAD application once you are married and file the I-485 as the basis for the EAD has changed.

True enough on both points - a K1 does not have to wait 2 weeks to apply for a SS card nor do they have to wait until married and filing for adjustment of status to apply for an EAC (although there are valid reasons to do both). Many people have a tendancy to convert 'should' into 'shall'.

Further to what Kez wrote, when and if your fiance does get that EAD card, and he sees when it expires, he may wonder why he spent the money to apply for it.

Thanks for the replies - I will let you know what happens on 02/08 regarding the EAD. As far as whether it is worth it, I guess that it is subjective. If he gets employment before our wedding on 03/17, then it will likely be worth it. If not, then it probably isn't the end of the world either - although he certainly would be happy to start working before then. I'm not sure what the reasons would be for waiting 2 weeks to apply for a ss#....it doesn't seem to make any difference. If they don't have the data at the time of the application, they obviously won't issue the card until they get it.... In either case, the card gets mailed out once a number is assigned.

Basically you just applied for an EAD card that will run out when his K-1 does (90 days after his entry) and then you will have to apply again, with fees again, to get a card for a year (but you're looking at a 90 day wait from the time that you apply for EAD with your AOS (after your marriage). If his POE was at JFK you could have got a "free" EAD stamp on his passport that would have been good for the duration of the K-1 starting from the time he got his SS. There's some really good advice on this site and it has made our journey so smooth.

August 21, 2006 - Medical

August 30, 2006 - Rec'd packet 4

October 2, 2006 - INTERVIEW!!! APPROVED!!!

October 4, 2006 - Visa in hand!!!

October 7, 2006 - POE at JFK and got EAD stamp!

October 21, 2006 - Received Social Security card

October 28, 2006 - Married!!!!!!

AOS/EAD

November 10, 2006 - Sent off AOS/EAD

November 16, 2006 - NOA1 for AOS and EAD

December 2, 2006 - Biometrics for AOS and EAD

January 23, 2007 - Without any touches, we get letter for interview in March

January 26, 2007 - EAD card production ordered

January 29, 2007 - EAD touch - Approval Notice Sent

February 1, 2007 -received EAD card

February 8, 2007 - AOS touch

March 6, 2007 - AOS Interview - approved pending FBI checks

May 25, 2007 & May 29, 2007 - AOS touch- yay! it's been awhile

May 30, 2007 - email notice Welcoming New Permanent Resident

June 6, 2007 - Greencard in hand

REMOVING CONDITIONS

March 15, 2009 - Sent off I-751

April 10, 2009 - Biometrics

May 18, 2009 - APPROVAL LETTER RECEIVED!!! Without any online updates
