I-130 for CR-1-

Dear all,

Need your advice :help:

My fiance and I planed to apply for Fiance visa, but now we decided to get married in my home country and as soon as he will back to US after our wedding he will submit I-130 petition for CR-1 visa (Immediate relative). Any ideas how long we will need to wait till Texas Service Centre will issue the approval?

Even though you'll be sending the petition to the Texas service center, it will be transfered to the Calafornia Service Center, as all CR1 applications are being reviewd and approved there. Please note that you'll still have to send your application to the service center for your region.. it will automatically get sent on to Calafornia. Typically the USCIS says it can take upto 6 months to approve an I-130 application.. the average based on other VJ members timelines is about 3 months.. ofcourse it can be much longer or shorter depending on if you get lucky or not. After that you'll spend about 4 months at the NVC in New Hampshire.. My case is still there.. probably until end of Feb before it goes to the consulate. 01/26/07 - DS230 finally received 11 days after it was generated.. can anyone say snail mail..

05/24/07 - Interview date at Mumbai consulate - APPROVED!

07/10/07 - Received Conditional Greencard. Still waiting on the SSN

OK, so it means the best and fastest way is K-3 visa and not CR-1, and after in US I will apply for everything else. The most important for me is to be with my future husband as soon as possible.

Hi Elmira,

I'd apply for both. You can't apply for K3 without sending the I-130 anyways (which is the CR1). There are lots of advantages of seeking the CR1, as you'll be a resident once you get the visa stamped at the POE. With the K-3 you'll still need to go for Adjustment of Status here in the US, which means you won't be able to work, you'll have to go thru another interview, etc...

Apply for both and when the time comes make your decision with your husband.
