Now that they did away with DCF...

We got married on the 6th of Jan this year with the bright hopes of doing a DCF after his contract for work and lease was up in the UK Feb 28. He is flying out here the 3rd of March to stay a few weeks before going back home to Australia. Plans were for us to file our stuff there, but thanks to the new law thats no longer an option.

We know we need to file our I-130 ASAP, but for him to straight to Aust. seems pretty drastic. How can we show we actually are married and fulfill all the requirements they are now asking for like joint bank accounts, tennancy etc. witout he and I actually being allowed to live together.

We would like him to stay here for the 3 month limit, but that puts us in danger of problems. And, I just got back from London carrying literally half his posessions!

I am so confused and the more I read, the less I understand. I am so frustrated, alone and feeling hopeless because of all this. I am feeling like we should not have gotten married now. Damn the gov't for not giving anyone a heads up on the change of policy here. We would not have done this if we knew that 3 weeks later we would be cut off at the knees.

I dont know what to do anymore and am feeling so so helpless and that this is going to be another 2 years of heartbreaking distance. Australia isnt that easy to get to like the UK. Nor as financially feasable...

Anyone with any light? Anyone with hope? Anyone? :crying:

Go with evidence suggested in numbers 5 and 6:

or5) Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage);

or6) Any other relevant documentation to establish that thereis an ongoing marital union.

Letters from friends and family, photos, boarding passes, phone bills, etc.

2007-05-10: Biometrics appointment (both - Biometrics review)

2007-06-05: AOS interview letter date

2007-06-13: AOS interview letter received in mail

2007-07-03: EAD card production ordered

2007-07-07: EAD card received! (yay!)

2007-08-23: AOS interview (Documents / Interview review)

2007-08-23: Green card production ordered!!!

2007-08-24: Welcome notice mailed!

2007-08-27: Green card production ordered again... ?

2007-08-28: Welcome notice received!

2007-09-01: Green card received!

Done with USCIS until May 23, 2009!

Thing is... we have been married for 3 and a half weeks. We got to live together for 2. How is that going to be considered proof of an ongoing marital relationship?? And the only people who got to see us married are in the UK.

He cant even come see me!

Okay...I'm confused :help:

What is the new law against DCF? Did they really do away with it? Is this true for all foreign countries or is it something just in regards to Australia (where she's talking about)? Someone please help. I had planned on going the DCF route in Belize sometime in the near future.

Check the DCF forumn for the active thread... currently, all DCF worldwide has been affected. Whether temporary or permanent situation is too soon to tell until they sort this out.

The requirement is that you provide evidence of a bona fide marriage, not that you provide joint bank accounts or tennancy in common. Those items are simply suggestions.

Each couple will provide what they have to provide based on their particular circumstances.

Ummm,

I used a marriage license and my presence at the interview. It sufficed.

Since the interview came well after your I-130 was submitted and approved, pray tell how did your presence at the interview suffice as evidence of a bona fide marriage for the I-130?

Note also that when you submitted your I-130 the USCIS was not asking for evidence that the marriage was bona fide. They were asking only for evidence that a marriage existed, for which a marriage certificate - not license - is quite adequate.

The OP indicates filing for a K-3. That is the interview I was refering to. The I-130 wasn't approved for another 14 months.

I am in the same boat. We have been married only 2 months. However, I will get Affidavits from friends that were aware of our meeting and long distance courtship. I will also include the phone bills and the documents adding my wife to my US health plan. Since our marriage is still in it's infancy I would focus more on the basic evidence of relationship. I will include a letter stating that since our marriage is still new I will submit evidence of our strong relationship (the initial meeting, the visits, the letters, emails leading up to the proposal and marriage).

I initially got caught up on that new requirement and stressed over it. However, I hope the people reviewing this will understand that the marriage is new and therefore my evidence of relationship will suffice. Also, as Yodrak stated, it is more of a suggestion. I'll just make sure to give them more than enough to satisfy my case.

02/22/2007 - I-130 received by VSC.

06/12/2007 - NOA2 approval email received!!!

06/15/2007 - NOA2 letter received in the mail.

06/19/2007 - NVC receives case and assigns a case number!

08/27/2007 - CASE COMPLETE!!!!

09/06/2007 - Case forwarded to Sydney

09/14/2007 - Wife receives Packet 3. Received NVC letter confirming case forward to Sydney.

10/26/2007 - Interview - VISA GRANTED!!!!! WOOO WOOO!!!!!!

11/18/2007 - Enter the US via LAX (POE). No issues thankfully. 20 minutes of processing.

11/30/2007 - Welcome letter (two of them) received.

12/19/2007 - CR-1 Green Card received.

09/23/2009 - Express Mailed Removal of Conditions application

09/24/2009 - USPS confirmed delivery to VSC

09/29/2009 - Check cashed by USCIS

10/01/2009 - Received NOA I-797C dated 09/25/2009

10/10/2009 - Received Biometric appt letter for 10/29/2009

10/29/2009 - Biometrics taken. Whole process took about 40 min including the wait

12/22/2009 - Approved for ROC!

01/08/2010 - Received text and email: Card production ordered

01/15/2010 - Received Green Card in the mail!

USCIS - N-400

04/22/2011 - Express Mailed Application for Naturalization

04/27/2011 - Check cashed by USCIS

04/28/2011 - Received NOA I-797C dated 04/26/2011

05/27/2011 - Biometrics taken. Process took approx 35 min with wait

07/29/2011 - Received Interview Appt letter scheduled for 09/01/2011 dated 07/26/2011

09/01/2011 - Interview and Oath. Now a USC! The VJ is over!
