Hey guys, just wondering when you all recieved your NOA2 in the mail did you fax the abroad emassy to open a so called provisional file, or it might have another name, for your fiance(e), and if so what did you send to them and what did you state? Thanks so much,

March 2006--Met while studying together in Bremen, Germany(what an unbelievable blessing)

May 2006----I flew from Frankfurt to Minsk, Belarus to be with her and her family(best time of my life)

July 2006----Presented her with a ring in Warsaw...the most wonderful, but fastest days of my life

July 2006----Back in Kansas, feeling half the man iam without her

September 2006--File for the I-129F at the NSC, then diverted to the CSC

September 2006--NOA1, CSC, September 18

October 2006-----Touched, only to correct a minor error in the spelling of my adress(better safe then sorry)

January 19th 2007---I just can't belive this, the day has come! Ketino and I are approved!!What a wonderful fealing it is!!

January 31st---NVC mailes packet to U.S embassy in Warsaw, Poland.

February 13th-- Ketino recieves packet 3 from the embassy

February 14th-- Ketino sends the packet back to the emabssy

On page 2 of this fax please find the original I-797 approval notice received from the USCIS Service Center regarding this petition for my fiancé(e).

I'm not sure why the example you cite recommends sending the original I-797. I wouldn't send it, as it is required evidence for AOS later on.

Previously when conditional files were done, the consulate needed the NVC assigned case number not the USCIS case number

I have no idea what you are talking about, what is a provisional file? I did nothing with the embassy and blew right through the process so maybe it doesn't apply in Manila.

That policy must have been in place for only a very short period of time, because it wasn't long after petitions started going through the NVC that provisional files were done away with. About the same time, actually. Prior to that, approved petitions went from the service centers directly to the consulates and it was the consulate that assigned the DoS case number, the NVC was not 'in the loop'.

Jasman - By the petitioner letting the consulate know that an approved petition was enroute, some consulates would open a file, called a provisional file, and issue the visa application packet to the beneficiary in advance of receiving the approved petition from the USCIS.

Interesting wording in the quote. The quote is in regard to sending the Approval Notice by fax, and by that means of transmission the original stays with the sender!

I never heard of this before. I wonder if it would be bad to send for my fiance because in amman from the time the embassy receives the file from NVC and the packet 3 is received back, it could take up to 1 year for the interview because they are so backed up with filers from Iraq in Amman.

Does anyone think this would hurt my case if I send once I get my 797?

So far 105 people have looked at this thread, but no one coming forward saying that the used the provisional file. Has no one even tried it? If so, didn’t it work? Speak up! Add the info to your signature!

I forgot about the provisional file (due to the overwhelming flood of sooo much K1 info here) until I saw it in tusconbill's signature weeks ago. He got his NOA2 in late Oct 2006, and the provisional file worked. I will definitely try it when my NOA2 comes. Can't hurt, and it might be a tremendous help! :yes:

People should start mailing in the request for the provisional file again, to the foreign embassy, immediately after getting their NOA2 – ESPECIALLY all those who are languishing at the NVC for so many weeks. Good luck to us all! :thumbs:

I am trying to do a provisional file. My NOA2 goes to my lawyer and she has not responded to my email inquiry. I will post about her response and if I will do provisional file without her help.

I was actually just posting/asking about this yesterday, but everyone on that thread (UK discussion) thinks it doesn't work - at least not for London. I may try it anyway because then I'll feel like I'm at least doing something productive and it's just a fax.

I read on a website elsewhere that someone had luck doing this with London, but I know the laws/regs/methods for processing K1s has varied tremendously over the past few years - so who knows.

My fiance will interview in Amman, Jordan. I am going to try it though - it shouldn't hurt us in any way right? Besides, once packet is received by Amman they schedule interviews as far out as 1 year, so anything to help shorten that would be good. I will let you know how it goes. Haven't gotten my NOA1 even yet, but God willing I'll have the NOA2 by end of Feb the latest.

(I've started a new thread but am adding my info in this thread too, to bump it up and have the all the Provisional File info in one place)

Provisional File Doesn’t Work in India; It’s Official – got an answer from Chennai

Yesterday I got my snail mail copy of NOA2, so I straightaway wrote an email to the Chennai Consulate in India (tried to fax but it didn’t work) requesting them to open a Provisional File and send my fiancé Packet 3. I got an email answer in a little over 4 hours! Wow! So bottom line is we have to sit and wait till the CSC sends my file to the NVC and they forward it to Chennai.

Hope people from other countries try the Provisional File too, because some countries DO practice it, and it could cut off weeks of waiting time.

We do not create a provisional file but the applicant may access the information on documents required for the interview at: http://chennai.usconsulate.gov/appointments.html.

When we receive the case here, we will schedule the interview and then inform the applicant.
