Hi everyone,

I am a student (F1 visa), adjusting my status to permanent resident, and I am a single person without any additional members with me. I had my interview this Monday and something happened. When I was there I was asked about mi financial status, they are concern if I become a public charge for the U.S and because of this they requested to find a sponsor before Sept 30, 2014 in order to complete my case. By God Grace, I found the sponsor and I am trying to get all of the information as soon as possible and before Sep 30. I have to go to the USCIS and submit the documents for approval, but I am concern about the timeline. I know that normally it could take from 2 weeks to 3 months to obtain the Permanent Residence, but in my situation by 3 months the fiscal year has already finished, Could it be possible to get it after Sep 30? or it must be given to me before Sep 30?

I have another question, Do you think it is better if a lawyer finish my case? and if so, what can she/he do for me? or does it make any difference?. I was thinking that it could be better to go there to submit together all of the information requested but with someone who represents me. What do you think? I do not want to lose the opportunity of having my permanent residence.

It is very important to me know what would happen if they do not give me the residence before Sept 30 and the advantages of getting a lawyer.

No visas can be issued after Sept 30 under any circumstances; and the program may end sooner if the annual quota is exhausted - which it is close to.

You say you have found a sponsor, so don't waste time with lawyers (most of whom don't understand DV and delay it unnecessarily - for which you have no time). Get the sponsor documents in ASAP. Visas are running out and the program may well close before Sept 30.

thank you for your answer. I previously talked to a lawyer, he requested to find all of the documents that are on the instructions of the I 134 form (affidavit of support) in order to submit all of the documentation in case it is needed. But the officer just requested a part of them (not all of the documentation listed in the instructions), and he said that the visas can be given from 2 weeks to 3 months (but as you are saying is not my case). My sponsor does not have access to the documents until tomorrow (no way before) he does not live in NY, he needs to collect the information and send it.

I think I have 2 options:

1. I can go by myself on Monday with just the documents that the officer requested. That documentation can be given to me by Sunday-Monday (it will be sent by email). With this option I think there is a risk that if I meet another officer they can request for more information.

2. I can go one time with the lawyer by Wednesday-Thursday, with all of the documents and talk with the officer with someone who represents me (in case need it)

I think when I got there (even alone or in the presence of the lawyer) they should put a stamp on my passport (I think a temporary green card), something like that. Please verify me this. I just want to go one time and be prepare if they ask for something else, I hope is not too late.

I am really open to here you guys and tell me if you were in my shoes what would you do.

You know the affidavit of support form must have an original signature on it. They don't take faxes or email 90% of the time. It is time to pay money for the fastest delivery of the I134 form ( the rest can be scanned )

This will not be over quickly. You will not enjoy this.

Just get the form and whatever your IO asked you to submit with back to USCIS as soon as possible. You don't need a lawyer to go with you. No lawyer can make them decide your case or put a temporary stamp in the spot if they still need more time to review your case. You will simply be throwing money away if you hire a lawyer at this stage. Don't delay, they're fast running out if visas for DV 2014!

I followed your instructions, I went on Monday with the officer and I gave the documents to him (without the help of a lawyer), they did not requested anything else by God's grace. He told me to verify in internet my status, and if positive I will need to wait from 2 weeks to 3 months to get the card. Yesterday, I reviewed my status for the I 485 form and it shows Card/production (the circle is fill in blue and it states that a new card has been ordered, and I need to wait from 2 weeks to 3 months). Please verify me if it means that I have already won the green card and now what I should do. Do I need to go to the USCIS or make a call phone to verify this information?

Just get the form and whatever your IO asked you to submit with back to USCIS as soon as possible. You don't need a lawyer to go with you. No lawyer can make them decide your case or put a temporary stamp in the spot if they still need more time to review your case. You will simply be throwing money away if you hire a lawyer at this stage. Don't delay, they're fast running out if visas for DV 2014!

Fantastic! Congratulations. That means you've been approved. You're now a lawful permanent residence. You don't have to do anything again. Just wait for your Welcome Lettet and Green Card to arrive in the mail, you should get all of these no later than 2 weeks - it will definitely show up in less than 3 months.

Today I checked my status online and now the circle is fill in DECISION. I do not know why it went back, but I suppose that the decision is already done. Please verify me this status.

Yesterday, I received my card employment authorization (it has an expiration date and it states that the card is not evidence of U.S citizenship or permanent residence). Please, could you explain me how it works? Do I need both cards in order to work?, really I do not know.

Thank you guys, and I am sorry if I am asking lot of things, but I want to make sure that I am doing ok, and I have a good understanding of everything.

The card is to allow you to be employed until you get your green card. If for any reason your green card is denied the card becomes invalid also. The fact they sent the card shows they at that time intended to issue the card. It may have been sent back if the IO forgot to sign something or include a form, don't worry too much.

This will not be over quickly. You will not enjoy this.

It's quite normal for the status to go back and forth. Don't worry, your green card is on the way!

Don't stress about the online status going back to the 'Decision' bubble, it is normal for it to go from CPO back to decision. It does not change the fact that you've been approved, your GC should show up in the mail by the end of next week or so.

Don't worry about the EAD card, you no longer need it to work because your status is no longer decision pending. You can keep the card as a souvenir. The EAD is often not useful to those processing DV based AOS since it usually takes about 2-3 months for the EAD card to be approved, and that's about the same amount of time it takes for the AOS itself to be approved.

This is partly inaccurate. The IO that conducts the interview and approves the adjustment at the end has absolutely nothing to do with the EAD card. Individual Field Offices adjudicates the AOS application while the Nebraska Service Centre is responsible for approving and issuing the EAD card, they do not cross check with each other.

Huh? bad lawyer, IMO, as it's the I-864 that's needed. Not the I-134.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
