So if I'm reading these instructions properly here at work, the I-864 wants 3 years of tax returns as part of your proof of income. I have a few questions regarding this that I'm sure have been answered, but I cant get search to give me the answers I'm looking for.

1. Can I print off my HRBlock E-file return and submit that, or do I need to get official IRS Tax Transcripts for the past 3 years?

2. I have not met the 125% for all 3 years, this year is likely to be the first that I will, should I still go ahead and use my cosponsor that I used for the K-1 process, just to be safe? Right now my income is about 3k/year over the 125% for my family size, and we live comfortably, but just to be sure should I have my mom fill out the paperwork as a cosponsor again too?

Thanks for input guys! With the wedding soon, I'd forgotten to think about all of this AoS stuff until this past week and now its going to blow my mind!

Hi there

As of late, only the most recent tax return is now required for the I-864. Check out this link HERE for more accurate info.

We used trascripts, so I'm not sure about your first question. We called the IRS and got the transcripts shortly after.

USCIS now only requires that you need the most recent year of tax filings (FY 2004, or if you've already filed, FY2005). With that said, you can use either for your actual application submission, but for your interview, you need the IRS tax transcripts, unless they are not available (FY2005 tax transcripts are not available yet. Dont know when they will be). For cases where tax transcripts are not available, the HRBlock printout will suffice as long as you tell the adjudicating officer at the interview that no tax transcript was available.

You only need to meet the 125% for FY2006 (they have new guidelines posted on the USCIS website. Therefore, it doesnt matter if you didnt meet the poverty guidelines for any of the years previous to 2006. If you do not meet the FY2006 poverty guidelines, use a sponsor on your I-864.

2005 transcripts are available... I just got them for myself. They're available about 2 weeks after you file...

Thanks a lot for the great info, I filed a while ago, already had time to spend most of the return too (hooray for a nice wedding) so I'll see about getting the transcripts.

Just printout your returns and use them. I sent in unsigned copies of my tax returns (I have been filing electronically for years.) Make sure to include the W-2s especially if you filed them jointly. I had no problems at the interview. Good Luck
