Real Estate as Asset for AoS I-864

Hello

I intend to lodge our I-864 next week. I am waiting on a letter from family that we can stay with them when we arrive if we have not yet secured a rental, and I am getting everything else together in the meantime this weekend. As we live in Australia, we intend to use our assets and show that we have 5 times the 125% of the poverty guidelines to support ourselves.

I understand that we need property valuations (professionally done) to show we have assets in our real estate (asset value less mortgage). We hade valuations done approx 7 weeks ago, and they are current until 24/10/2014.

Would we be able to use these as support of our asset valuations, or is there a time limit for the property valuations? If we can use these, I will post everything express post next week so the I-864 is with the NVC before it expires. Would that still be ok and acceptable for their purposes?

What are your thoughts, or if there is a fact sheet somewhere please feel free to direct me there and I will ready through it.

FYI - real estate is in Australia, other assets we will use includes some cash in the bank in Australia and in USA, and we have Motor Vehicles (leaving one for us to keep and not include in the valuations)... so at the end of it all we will have approx. 8-9 times what the 125% poverty amount is. We also have family on backup to assist if needed with income requirements in case we get told no, but I would prefer to do this ourselves.

Timeline

The assets need to be something the US government can go after if they need to so I am not sure if they would allow foreign real estate.

This will not be over quickly. You will not enjoy this.

I have read it is 3 times for sponsoring a spouse, unless the assets are overseas (not located in USA) then it is 5 times. Regardless, we have double what they want if it's the larger number, so I am not worried which one is technically correct. We are covered in that respect either way.

Plenty of people have used assets from overseas from what I have seen on here. The requirement is that they are able to be liquidated within 12 months should you encounter financial hardship, not the assets must be available to the US government.

I could be wrong, but that's my understanding. I am still reading and trying to sort this part out though, so will see how I go in another few weeks! :-S

We are going to go ahead and use the previous house valuations as from what I have read they need to be 'recent', although recent isn't defined.

Hmmm where did you read that overseas assets must be 5 times value? I`m asking because we are planing to use assets from overseas also.

Oh ok, because in I-864 instructions i did not find that. We are planing to sale one apartment to meet poverty amount but we are first waiting for I-130 to be approved.....good luck:)

What can be used as assets?

Can the immigrant visa applicant count assets that he or she owns that are outside the United States, such as real estate or personal property?

Yes, under the following conditions:

The assets must be convertible to cash within 12 months

The applicant must show that the assets can be removed from the country where they are located. Many countries have limits on cash or liquid assets that can removed from the country

The net value of assets is at least five times the difference between the sponsor's income and 125 percent of the poverty guideline for the household size.

Here is what I have Found online

It's under Faqs: assets, fourth one down. So I think it is 5 times the poverty level. I could be wrong and misinterpreting it wrong, but that's how I read it.

Oh I see...

If my wife (petitioner) uses her assets is three times, if I (immigrant) use assets is five times.
As I understand if you can prove (with bank statement) that you can make money transfer of xxx.xxx$ to US account, you are ok!? :)

I hope that we will sell apartment and move money to our US account before AOS package.
