If I were you, I would use the K-1 (fiancee) route as it would make your life much simpler and easier when adjusting status. You would also enter on the RIGHT type of visa with USCIS not being able to doubt anything about your declaration. Do it right, this is your life and hers.

07.16.14 (Day 8) NOA1 received and Rejection notices for I-765, I-130 and I-485 due to address error

07.17.14 (Day 9) Re-sent package via Fedex 2-day priority with correct address

07.24.14 (Day 4) Received Text notifications and Receipt numbers at 2:30 AM EST for I-130, I-485, I-765, and I-131) - Lesson learned!

07.26.14 (Day 6) Cheques cashed for I-130 and I-485. Mailed NOA's on the way

07.28.14 (Day 8) Paper NOAs received for I-130, I-485, I-765, and I-131. The first two in Acceptance status and the last three in the review status.

08.03.14 (Day 14) Biometrics appointment set for 08/15

08.11.14 (Day 22) Biometrics walk-in successful

08.21.14 (Day 32) Case moved to 'Testing and Interview'

09.15.14 (Day 57) EAD Card/Document in Production

09.19.14 (Day 61) EAD Card Mailed

here is the scenario:

Is ILEGAL to come on a b2 visa with the intention to marry and STAY. You can go and get marry and then go back and your wife file for a cr1 for you which is a visa for a spouse of US citizen. it takes 8 to 12 months to get it.

You can also file for k1 visa which is a visa for a fiance of an USC. it takes less but you need to get marry 90 days within your arrival and then apply for AOS.

The thing is that even though it's pretty much illegal what are you "planning" to do, people do it anyways and the government still grant them (in most of the cases) the green card. If that is what you want to know.

And it is quite legal once you are here to change your mind file and adjust.

Right, and people quit their jobs in advance of and in anticipation of exercising their opportunity to use the B Visa all the time? (Sarcasm intended) IMO, it looks like blatant planning to me and frankly I don't find that "amusing".

Yes, they can "change their mind" and many do as previously pointed out. How I wish my now spouse would have "changed her mind" at the beginning of our journey and reaped the benefit of doing so.

Many tourists come in and change their minds once they are stateside. So long as you don't lie at the POE upon your arrival you shouldn't have any problems applying for a GC, if you were to decide to get married after you entered the country. People do it all the time.

We have decided to use a K1 Visa (the way it's supposed to be done). I guess it's better that way. Hopefully we get it approved and everything goes well.

Being apart can be hard, but it is the best bet to do this.

I agree with you.

I doubt if this is a major factor, more likely people staying who have no adjustment opportunity. Or abuse their status or more often both.
