even though the consulate had requested a co sponser, USICS wont request if my hubby now makes enough money?

When applying for a K-1 visa, you're not a relative and not an immigrant, although you can convert to both as that is the intended reason for the visa application. But because you are not one, considerably discretion is given to the consulate on what they have to accept for evidence, and even what standard they wish to use. You are now a spouse (relative) of a USC. When you are a family member of a USC, that discretion goes away and strict rules must be followed by the IO in adjudicating your case. So if he meets the 125% and can prove it, the IO cannot say well this is very close, I want a cosponsor, or worse yet say its too close and I won't accept a cosponsor.

Another question that we're both confused about in the i-864 form. Under part 5, Household size. It asks the following:
Your household size - do not count anyone twice

person you are sponsering in this affidavit : we put one

then it says, Persons NOT sponsered in this affidavit - we put himself, and our child, but then it says if you're currently married enter 1 - leave it blank because, I'm already counted as the person sponsered for the affidavit?

Total household size is 3

Total household size is 3

Leave it blank or put a 0. It states not to count anyone twice. You are counted as the one being sponsored in the affidavit. Everyone counted after that falls under, "Persons NOT sponsered in this affidavit" You are being sponsored and counted in #1. You are not counted again as someone not being being sponsored.

Hopefully someone can answer this. Fee wavier -- I had to have a co sponsor.. with all the medical bills with pregnancy -- could I still be considered? I know I was suppose to get this done weeks ago. But my husband has been procrastinating on the letter from his employeer

Fee waiver for the $1070 is not possible for those adjusting from K1 unless it is a VAWA case (see I-912 instructions item 5a-f) http://www.uscis.gov/sites/default/files/files/form/i-912instr.pdf
