I am USC and planning to visit India for 4 months and file DCF for my husband who is presently an Indian citizen. Well, my question is, when we have to sent them I-864, do I have to be employed at that time to prove the domicle. Or is there any other way I can prove the domicle.

You do not have to be employed to have a domicile; please research 'domicile' in the immigration context and see if you think it is something that you will abandon (in the US) by being away for 4 months.

Hey

I also lived in india and filed DCF. I stayed for 8 months actually, even more reason to question domicile. But i didnt get questioned.

I have an idea...but im not sure it would work for you.

FIrst - do read the notes on domicle. theres tons of ways to show youre domicile in the states.

do you have a car? bank accounts? credit cards? any bills that you will be continuing after you leave? car insurance?

BEfore i left the states i filed myself as an LLC.

I genuinely had a side business for years and when i left for india kept that business going (its all over the net). Anyways - i used this in my financials and they didnt second guess my finances. I did give them copies of all contracts though - so you would have to have clients to show income i guess.

anyways - being american (ok - speaking english as an american) will give you tons of job opportunities in India. Or - maybe you ahve a side job also taht you can take with you like i did. additioanlly there are tons of NGOs in India and you could EASILY get a job, or even a part time internship kind of thing. This would be enough income to keep you passable for the visa requirements.

But there is a USCIS Sub-Office in New Delhi. Since 'DCF' in India is not really DCF it may still be available?

Sure they might, if they have a petition that was not properly adjudicated because it of new procedure it has to go back across the hall to the sub-office to be re-examined.

Hi Anitha,

My wife is exactly in the same situation as yours, and we filed the so called DCF in January, and we got the packet 3 and waiting for the interview date. By the way, we are from Cochin and I guess you too are from somewhere in Kerala basically.

My wife is not working anywhere since 2005 and we are using her parents as co-sponsors using I864A. And for proving domicile we are planning to use her utility bills mails etc.

I will give you the updates as we progress, and in the mean time if you need any assistance you are welcome to ask.
