So what if I can't take waiting anymore

Can I go wait this out with my husband in Albania? We filed I-130 DCF. Can I live there or I HAVE to be living in the US? What about work (since there really isn't any in Albnaia? I have been working my whole life (as a teacher). I don't have savings. I 'd have to sell my car and put my stuff in storage. Any thoughts?

I see from many of your posts that you're about to blow a gasket, but I really just encourage you to wait and see what happens in the next few weeks.

You're not going to have to start over from scratch; there is going to be *some* delay, but since you didn't know how long it would take in the first place, that shouldn't matter.

Try to not fret over this. Your I-130 has been accepted and adjudicated. If it needs to be re-done, it will be sent to the right office, your namecheck run, and the visa appointment scheduled.

Don't panic!

I see from many of your posts that you're about to blow a gasket, but I really just encourage you to wait and see what happens in the next few weeks.

You're not going to have to start over from scratch; there is going to be *some* delay, but since you didn't know how long it would take in the first place, that shouldn't matter.

Try to not fret over this. Your I-130 has been accepted and adjudicated. If it needs to be re-done, it will be sent to the right office, your namecheck run, and the visa appointment scheduled.

First, thank you for being one of the only people with some words of encouragement. Yes, I am ready to blow a gasket! My husband and i said we'd give it a year, after that I would go wait it out with him in Albania. My concerns are this: Will me living in Albania and leaving the US affect my visa petition?

We were told in December that our interview would be in 2-4 months. I am just concerned how much longer this will now make it?

Money, work, a place to live when we get back to the states are all concerns (if I decide to leave and wait this out with him),,, ANYBODY with advice or a simialar feeling or experience, I would love to hear thoughts and advice.

Amy, I think the first step is for your husband to contact the embassy in Albania to inquire what will happen to his petition. They'll be able to tell you where/if they are forwarding the approved petition and maybe give you an estimated timeframe of a new interview date.

Amy, I agree that a contingency plan is a good thing--you bring up questions that may have to be answered at some point. It's simply my feeling that today is not that point. You are not going to be left months waiting with no information--you are in the system at a reasonably sized Consulate and you've already had contact with them. Let them find out what they have to do before you demand answers (that they can not give) from them.

I have a hard time seeing how it could be a year+ to complete your petition. You could re-file and be done in less time than that, so just sit on your hands a bit. I love talking about moving though, so if you like researching, start looking at what it takes to move over. It will impact your immigration case, but it won't kill it. I was living overseas, remember, and didn't have a job in the US to come back to either.

It sounds like the consulates who have "approved" local petitions on hand will send them up the chain to the Field Office or potentially sub-office that covers them (Rome or Vienna for you?). Some Consulates are sending letters to people saying that they will hear next from the NVC.

misa: the beneficiary doesn't have a petition yet--he doesn't officially exist to them. The USC will be able to talk to someone about her file, but again, I'd urge you (all) to wait until the Consular folk know what they are going to do. I'd bet 100 drachmas that they do not know yet.

Keep the faith, Amy, and try to hang loose for a few days until more news comes out.

Wouldn't they have the beneficiary's information? Amy's timeline shows an approved petition and packet 3 received and sent back.

My husband did call the embassy and they told him "don't worry. your case is fine" BUT the Vienna office did NOT MAKE IT SOUND LIKE THIS AT ALL! From what I've read, it seems that cases that have been adjudicated will not go to USCIS offices. I am not sure if ours is adjudicated. They told us on July 5th our I130 was approved and we've already received and turned in packet 3....

So, I don't know. But we will keep in contact with the embassy (although they never answer the phones or it's busy PLUS it's very expensive to call. We will also keep in contact with the Dept. of State to see what the hell is going on!

I think that's the best thing to do, stay in contact with the embassy. Wait a few more days and then contact them again if there is no new information. Are they any good with email? I know a lot of consulates and embassies are better with email than by phone.

Adjudicated = "approved" or "not approved". You already know which one you are.

It doesn't mean anything though. Please have a look at the IMBRA forum for a refresher; if they are backdating the legislation, the "approval" is invalid and has to be redone.
