Request for Evidence

On September 25, 2013, we mailed a notice requesting initial evidence in this case. Please follow the instructions on the notice to submit the evidence requested. Meanwhile, processing of this case is on hold until we either receive the evidence or the opportunity to submit it expires.

I would like to inquire if it's still possible to submit RFE for a K1 visa petition. The RFE date was last year September 25th, 2013. I called and was told it's still opened. Is it possible since it's almost a year.

What? No, that expired long ago. You usually have 87 days to respond. You should have gotten a petition denial notice nearly a year ago.

No idea who you called but if it was USCIS then do what they said. I doubt this case file is still open but if USCIS said it was then what choice to do you have? The RFEs I have seen including my own needed to be responded to within 90 days.

Send in the information they requested in the RFE immediately. Strange that the case would still be open after this long, but things sometimes do fall through the cracks. The worst you lose is postage to respond to RFE and best case they accept docs and you don't have to go through the time and expense of re-petitioning. I wouldn't get your hopes up though...

You mention the RFE was delayed. When did you receive it? Was it delayed in the mail? Was it misplaced and you have only just found it again? Was it misdirected to a wrong address? Most RFE's will have a date stated on the form or its instructions specifying when the evidence needs to returned. If that is not stated, then there is a good chance you have up to a year in which to supply the missing evidence. The fact that you were told on the phone that it is still open is somewhat reassuring, but unless you spoke to an actual immigration officer rather than to the front line call center staff who answered the phone, that may or may not be accurate.

Was the RFE for the I-129f petition or was it for something requested by the overseas Consulate? If it was for the I-129f petition then I would take the RFE notice, the requested evidence, proof of why you have delayed in responding (postal stamped envelope showing more recent date or statement from your postal carrier/post master about when the letter was delivered) or proof of change of address where they sent it to the wrong address, etc. and send it by the fastest courier method available (usually overnight by USPS) along with a cover letter requesting that they consider your late submission and giving the reason for its late submission to the specified address. It would absolutely need to be received prior to the September 25, 2014 year deadline if it is to have a chance.

If it was for documentation requested by the Consulate, you would do the same thing but send it to the overseas address listed on the RFE.

The best case scenario is they will accept it and continue the processing on your case. The worse case scenario is that they will not accept it and the file will be closed for failing to respond to the RFE. This would not stop you from re-filing all over again, although the money and time spent on this particular processing would be lost.

usually, the postal piece of the RFE contains a specific time window in which to submit evidence.

I'll have to guess that you've missed the window based on the notice date - usually one is given between 30 to 120 days , and the duration is in writing in that piece o postal mail.

You've not mentioned the postal mail piece, so I am dubious about what is what, really.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I am confused, I looked at your timeline, it says you received an RFE on 9/25/2013 and you already responded to the RFE on October 7, 2013, is this a second RFE??? This is strange, I guess if you called and they say it was still open then maybe they lost your first RFE response if you sent one before or they never made a decision and you will have to respond to this one now.... Did you move from the original address? Did you receive a denial letter from USCIS?

Cocolucho, I had only one RFE. I'm sure they never received my october 7th response. I nearly gave up because all this while l was expecting to receive a denial notice but l called and they said my case is still open so l should send in the RFE. The RFE is just about a birth certificate. But we added the birth cert when we submitted the whole package. On the uscis website it still says .......
