Green Card for a parent who's currently in US

How do you apply for your parent who's in US on visit visa? 21 over US citizen. Do i130 and i485 are both needed or only i485? Asking on the behalf of a friend.

6/19/2013- ALL Forms Sent to Chicago Lockbox- (i485, i130 with rest)

 

 

6/21/2013- Package received in Chicago Lockbox

 

 

6/26/2013- Email and Text Notification received in the evening- Package received and accepted at USCIS smile.png

 

 

6/28/2013- They cashed the checks- $420 + $1070 = $1490 smile.png

 

 

7/2/2013 - USCIS Mail notification received (all the forms are received and are in process)

 

 

 
7/3/13- Biometrics letter received- for 7/19/13- Day 13
 
7/9/13 - Early biometrics done! - Day 19

 

 

8/5/13 or so - Status changed for Ready for scheduling

 

 

8/20/2013 - INTERVIEW SCHEDULED FOR 9/20/2013

 

 

8/21/2012 - Interview Cancelled! ;(

 

 

8/22/2013 - 2nd interview scheduled for 24th September.

 

 

8/27/2013 - Online update - EAD card ordered!

 

 

9/5/2013 - EAD card received

You would file concurrently (I-130&I-485) in addition to the other forms and documents needed for Adjustment of Status.

Do they need to file both i130 and i485 ? because from what i read, if the applicant is in US, then you file only i485? Someone please elaborate.

Yes - and few more as well (I-693 and I-864 at minimum) - read the guides and I-130 / I-485 instructions on USCIS site.

If you are concerned about which one is necessary, the USCIS site is the place to visit as it has many different guides on the how-to process of getting visas or residence for relatives.

I see this post was a month ago, but I'll throw my two cents.

He needs to file both at the same time, plus whatever other forms go along with those. The I-130 establishes that there is a relationship that is valid for immigration purposes and the I-485 lets a person adjust their status from a nonimmigrant (tourist, student, worker) to an immigrant (LPR).

If he doesn't have the money right away, he can submit the I-130 first and then submit the I-485 later, he just has to keep in mind that unlawful presence will accrue after the authorized stay expires. It is forgiven when the I-485 is approved, but it's always best to file both as soon as you can.
