Lawyer at K-1 interview in Brazil

Hello,

My fiance won't be able to come to the interview with me, but I really didn't want to be alone (seriously, can't handle anxiety alone).

I read that in Rio they allow your lawyer to be in the waiting room with you. Well, we didn't use a lawyer, but my mother is a lawyer and she would be willing to go with me.

For her to be able to go in with me would she have to have participation in our case, have signed something or anything like that?

Would you take your mother to a job interview? Seriously, the interview is not even as scary as that. You'll be fine.

The question is: what are the usual requirements for a lawyer to be let in the waiting room?

If you didn't use a lawyer for the process, in my own opinion it'd look a bit weird having one there now.

I understand anxiety but if you can't do this alone then you'll have trouble being in the states alone.

It's just a general chat to someone about your relationship. It's not scary.

You know your relationship is genuine so you don't have anything to worry about.

You'd be prouder of yourself for getting through it by yourself.

Guys, thanks for trying to help, and I don't mean to be rude, but it's really my choice and each case is different.

I have been using my mother's help at this stage, gathering the documents. I am not done because I haven't even gotten the interview date yet, but the thing is I haven't seen a "field" to put lawyer information or anything like that.

So, is there such a thing?

The space to put an attorney that helped was in the paperwork you filed, in the K1 visa form you already sent, dont know if they allow to put anyone at this point because they already review and approved you without anyone else but you and your fiance, plus I dont believe is a good idea when they already approved that part in US and dont know if that could even cause a problem. As an advice go by yourself, your mom can take you to the consulate and wait for you outside, take it as one of the first things you will do by yourself... when naturalization process come, even AOS or ROC sometimes will be by yourself, no mom or husband...

I see. I just thought the petition lawyer had to be American, and since they say they allow lawyers to attend the interview, I was confused.

This is honestly uncharted territory for me and the best I can suggest is to try calling the embassy to find out what the requirements are since this is solely under their discretion. Would appreciate if you could keep us updated on what you find out.

That's probably your best bet. If the answer you get is what you want, I'd suggest printing a copy of the email to bring with you.

Why not? Offhand, it looks suspicious. If you have a genuine relationship with no red flags and no problems that are going to put you under extra scrutiny, why have a lawyer with you? It creates a red flag.

I thought it was common...

I have no red flags, I'm just worried about the affidavit since we're using co-sponsors and we're very young.

But yeah, I'm thinking about it.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Well, is of course your choice to have your mother there with you.

By my experience past april, the interview was smooth and quick, the consular officer was very nice and polite. And there is also someone there to help you with the papers, she or he checks everything you got before the actual interview.

The only thing that people do not comment much, is that the interview is with opened doors, you stand at a window, so what you and the consular officer says, everybody in the waiting room can hear. I wish that they had done that differently, but the fact that the officer was nice, compensated that to me.
