Hello Every one I am new here and we're planning to petition my step daughter (unmarried) and her 3 years old son. My wife is a Filipina and she's already here in US and I am american. we got married when my step daughter was 13 years old and now she's 19.

Q--- 1. Can I petition her under my name as a step daughter?

2. If I use I-130 form for her what about the baby? Do I need separate form from her mom since he's a minor?

3. Since my wife and I joint filing of Income Tax Return. Is she need also to give her W-2 ?

4. 2016 my wife will apply her US Citizen. Is this not affect to her? or she needs to wait to apply her US Citizehip until the

petition for her family is done?

You can petition your stepdaughter directly, but she would have to petition her son separately once she gets here.

If your wife petitions her, your stepdaughter could potentially age out. Make sure you do the necessary CSPA calculations before deciding on this path. Recently, USCIS has been auto-expediting petitions with Filipino/Filipina beneficiaries, so that could work against you from a CSPA standpoint. The upside is that both mother and son could come together.

My wife came here last year March 2014 under I-R1 category. I think I will petition her (stepchild) and her son will be leaving as of now, beacuse of her age. If my wife will petition both of them we're not sure if they can get a VISA as soon. In this case do we need new Manila case number or we can use our old case number? Because during the application for my wife she wrote her name(my stepchild) is to be follow her in US but we don't know when.

Any ways thank you for your informations it's a big help for us!
