Because limits are different - 100% of poverty limits for I-134, 125% for I-864 - if I remember correctly.

na - the vice-consuls, worldwide,

use the I-864P when evaluating data on an I-134.

military personnel get in at 100 percent, everyone else at 125, I-134 and I-864.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

List him as 'cousin(godson)'. He can check partially dependent, but that won't really matter because he will be counted in the household anyway simply because he claimed him on his taxes. You have a co-sponsor, so it doesn't matter if he doesn't meet the income requirement for his household size.

Listing him incorrectly as a child should not get the K-1 denied, however, he should file an amendment with the IRS to get it corrected. He has no children and should not be claiming any children on his taxes.

He put "godson" and "partially dependant" and mailed the documents to me...do you think he really should put cousin instead and mail me that page too...?

I really hope it won't get my visa denied. I am just paranoid at this point, that something will go wrong. Afraid they might accuse him of some tax fraud and therefore deny me, or see something wrong with the I-134 and then see the tax transcript where it states that he claimed "son or daughter" and deny me before even talking to me, on the spot!

Doesn't this cause him another dependent on his I-864?

So he must show more income!

Yes, it does, and I will have a co-sponsor for the AOS anyway

That should be ok. I would just leave it as he did it. Try and relax. Take deep breaths. He just needs to amend the taxes with the IRS for the incorrect relationship mistake. That does not make you ineligible for the K-1 visa.
