Refusing to GO to ROC Interview

IMHO what makes it harder for you is that it appears she did not try to scam you in the sense most do, which is to obtain financial gain from the situation or wait until the permanent GC is on hand to disappear.

If anything it seems she did what she did for the kids without any regards for her own predicament. I don't think it solves anything but it should help you heal from the experience a little more easily.

My day is kind of sad, for one you think you know the person ie 9 plus years. You provide for that individual faithfully over that same time span then you find out it was all for nothing. No bitterness, no hatred just sadness for her daughters. I truly believe she had her kids at heart but she went about it the wrong way. When I tried to put her on the right track she just never got it and I ended up where I am now.

I spoke to her friend who called me. He friend said she doesn't understand why they asked her so many questions. Apparently the interview lasted 3 hours. She told her friend she did not understand why they asked her if they thought she felt threatening, if i had ever assaulted her, if I had ever caused harmed to her girls. She told her friend she said no to all the questions because I have always been very nice to them and took care of them. She said they asked her why she came to the United States and again she stated was to give her kids a better life.

Her heart was for them and not me and now the kids are the ones that end up getting the short end of the stick. They were uprooted, brought to a new country and had to adjust and now they will have to return. So, this makes it a very sad day for me. One would think I would be jumping up and down with joy but there is no joy in what I had to do. You only can take so much...

Her friend said that she cried most of the night not for herself but for her kids for she just wanted them to have a better life.

I thought I would be delighted with the out come but I am not. :( :( :( :( :( :( :( :( :(

OP mentioned in a later post that his wife didn't realize she had a conditional green card and required an interview.

I am a little confused, Thrusday I received letter from USCIS asking me to come in for an interview. It stated that before issuance of Permament Green Card to benifiicary that an interview is required. I thought since I did not go to the interview she would be denied. So, I do not understand why they want me to go in for an interview.

I have no desire to go in for the interview..........

So respond back with a notarized letter stating you will not attend an interview for her and your reasons for it. Follow up with a visit to the office (if close) and tell them verbally you will not attend an interview and why.

It is possible she gave them some excuse as to why you were not at the original interview such as work, out of town, etc.

I would send USCIS two letters.

In one, I would simply say "In regard to your letter re: A999999999, requesting that I appear for an interview, I decline to appear."

I would also send another saying "In regard to the removal of conditions for Jane Doe, registration A999999999, I am the applicant's husband and the petitioner. I believe that the petitioner did not enter into the marriage in good faith." Then give the reasons.

I've been told that USCIS does in fact frequently get information from third parties. Sometimes it's anonymous. You can request that it be kept confidential. They will give it such weight as they deem appropriate.

Tucking 14 what you mentioned regarding to keep confidential ,it does not exist in the law, USCIS can call and inter view who they want. Confidentiality is just for cases filed by Vawa self petitioners , and l751 based in extreme cruelty, besides that they call who they want .THere is no need to submit two letters either. He can decline to go and that is it , he can mention that he was.scammed if he wants to say that .

on 2nd thought -

since he prepped the casefile and put all of this 'stuff' into the casefile,

IMO -

he should go into the interview, with a copy of what he submitted,

ask the IO to pull the A-File, then flip to the section in the A-File that contains this 'stuff'

and then

ask the IO to focus his questions on this section in the A-File.

I think the IO will finally 'get it' - and if not, ask for the supervisor.

IMO, it's best to handle this 'stuff' face to face with an IO, if'n you really want the results expected when putting 'stuff' into the casefile, prior.
