thanks for the quick reply, I have seen this site. I am currently in MN with her as I am allowed to be in the US for up to 6 months. Can we get married in MN and then apply for the visa?

As long as her J1 allows for a companion visa, I don't see why not. Even if you have to return to Canada to get the visa on your passport you can certainly start the process stateside.

Does anyone know of any issues with us (my partner who is a Canadian citizen holding a J1 Visa currently working in MN) and myself a canadian citizen currently "visiting" her in MN, getting a civil union done in MN (It is legal in MN).

The process after that is to apply for a J2 visa for me while I am still visiting in MN and then as John said returning to Canada when the time comes to have the Visa put on my Passport.

I am concerned that there are/will be pitfalls that I can't even conceive of at this time with regards to there being perhaps waiting periods between having the civil union and then applying for a J2 visa or crossing the border in the future and returning again etc....

Thanks in advance for anyones thoughts or helpful advice on these matters.

Just to be clear -- it can't be a "civil union", it has to be a marriage. Not sure what those terms mean to you or in Canada, but they mean different things here. Once you are legally married, the J1 sponsor has to provide a form (DS-2019) for you to use to apply for the J-2; can't apply before you have that form.
