My fiancé and I just sent our I-129f package for the k1 visa a few weeks ago .. we plan to get married at the court house as soon as we are approved to speed up the process. I have 2 questions that I am hoping someone can help me with!

1. I believe that once I cross into the united states and we get married(where he lives and where we plan to live) i am not able to come back into Canada(my country) until our marriage visa is approved. is this correct?

2. We are planning our big wedding on Sept.5 2015, so if the above is true, should i also file a request to travel form along with my AOS and EAD application? does anyone have any experience filing the request to travel? How long does it take to get approved etc.

After the marriage, you'll file an AOS (Adjustment of Status) and once you receive your AP(Advance Parole which you mention in #2) you may travel...or if you receive your 2 yr GC ...which ever arrives first

How long does it take to get approved etc. AP and EAD are bundled with the AOS, filed together essentially. Hi,

When you file for AOS (form I-485), you will submit form I-765 for employment authorization card and form I-131 for advance parole. Sometime ago, these were two separate docs, but now they are conveniently made into one credit card sized card, similar to a GC. The good thing about this process is that by submitting these forms as part of the AOS package or even afterwards they are free to submit. While not required or even if you may not need to travel, it is highly recommended that you apply for it when you submit the AOS package so that you can have it in hand in case you may need it.

As soon as you receive this document you are able to travel. Do not under any circumstance leave the country until you receive this card. I'm not sure about the processing times, but I see in a lot of people's timelines that they are approved anywhere from 60 to 90 days. So you are looking at potentially 90 days without being able to leave the states or be able to work. You are free to roam within the country though.

I went through this last year. I applied for AOS, EAD, AP all at the same time. I filed early June, and received EAD and AP by end of August and about 3 weeks later received the conditional green card (that has everything all together in one card).



I also had to have a biometrics appt. In Texas it was pretty quick. Bio appt. was about a month after I sent through the application for AOS.
