Ok thanks for all the advice; I'm sure this topic will be around for awhile considering we are just starting this process. The $280 fee was paid on the phone with USCIS for the complete package of forms and have them filled out online. Today we signed them and organized them as requested by USCIS, and copied supporting documents. We also spent a good amount of time gathering pictures, letters, a hotel stay, and other documents that are proof of our relationship. The next step as far as I can tell is to complete the medical exam, (as we are waiting on the blood results should be done by Monday;) and have that included into our packet. We are told we will be handed another form from the immigration doctor I-693.

Forms we have filled out:

I-130

I-485

I-765

I-131

G325a

I-864

G1145

So just to recap, I need to be very sure about this. My wifes ESTA visa waiver expires 9/22/14, I should NOT allow her to leave the country? Keep her here even though its expired? Because I don't want to get into any kind of legal trouble with the government.

Questions from my wife and I:

Who do we make the check out to?

Should we overnight the packet we have created?

What are good steps to take in this process?

What other fees can we expect?

I would also like to add this forum has helped give us great piece of mind and helped us to relax a little. You all have been wonderful, my wife and I can't thank you enough.

Could you please provide a link to USCIS website where they can charge you $280 fee for package of forms?

I'm sorry but I don't think I would be able to locate any page requesting money for the forms. All I can say is that my wife and I did pay for them, via credit card. We made an appointment online on infopass got a call and thats what prompted this process. At that time we received an online account and access to the forms as well as an e-fill ability. Thats about as much as I can recall. FYI this phone call was around 2 months ago, but we only now have saved enough to file these forms hence the delay, and lack of time. But if its true she can stay after her ESTA expires to complete the paperwork we should be ok?

Are you sure the people you contacted is USCIS? Can you post the number that you called and also confirm that the website where you got these forms is "www.uscis.gov"?

There is no fee to get these forms even if USCIS sends them to you. These forms are completely FREE. I believe you may have been scammed, and if so I would contact the credit card company and dispute the charge.

I am not saying I don't believe what you say, but it is the weirdest thing I've ever heard (rather read). When you go to www.uscis.gov and you go file for green card through a US citizen spouse, it tells you specifically which forms you need, and you download those, free of charge. I am not sure at this point we'll be able to help you much since you've done some special route that I, and most of us here, have never even heard of. Either it's a new thing, or you have misunderstood something along the way and doing something else that you're paying for $280. I don't oversee what you did, so I cannot judge in any way...but it's weird to me/us, and new. Online account everybody has once they fill that G1045 (or whatever it was called) form and sign it...but that happens once we filed all the other forms along with that one. Good luck with whatever you are doing at the moment...I really cannot comment, or help to you as this is super different than how we -here on this board- have done our AOS. Maybe you'll come across another single soul who has done what you are doing...

As mentioned previously, the only time you may be charged is to have the forms filled out and prepared for submission. This is usually done by travel agencies, law offices, etc.

The above website is the USCIS legit website. all United State government websites end in .gov.

You can download all your forms and instructions here for FREE. When a US citizen petitions for their spouse all fees are paid by check or bankers check with the petition.

Read these forums and wiki's carefully here. And be very aware there are a LOT of websites that will con you out of your money by things you can do yourself for free.

Again, read the guide I linked above. It will answer your questions. Your wife enters a period of authorized stay while you go through AOS. If she leaves, her application is abandoned and you will be out a lot of money. Until she gets AP, that is.

Seriously, read the guides and instructions before sending anything.

Charge is in dispute as of 9/14/14. I looked on the government website the forms are identical. This is the site I got them from: http://www.uscis.gov/greencard

(1-800-375-5283) I can't recall why a charge was made, but its not going to be paid. I still have all those forms filled out just waiting to file them, so do I need any other documents? Because the page says I have to include my wifes medical exam with the packet, or can that be mailed latter?

If you are filling for AOS you wife should NOT get out the country....

If she wants to go back to Europe (before her ESTA expires ) she can, and you can ask to have her in the states with a different visa process.

But if you are going to do AOS she needs to stay even if her ESTA expires.

Also since you said you started it 2 months ago.....

Did she come here with the intention of marriage and stay?? Was it planned already??? Because it's illegal to do it that way then.

I'm really confused about the fee you pay.... but you will still need to pay USCIS the fees regardless what you paid already the official fees are:

$1070 for form I-485 and $420 for form I-130

In the uscis website it says what you have to put in the check click here so you can read the instructions:

Yes you need to send the medical exam with these forms :)

I agree with CdnRN on reading the guides. It will make the process a lot smoother and will avoid potential delays such as RFEs.

I must have missed something here, as when you filr AOS, and EAD/AP, it is one cost for all about 1070. .,,.,that is for a K-1.,.,but we are talking about complex visa's I have no knowledge of.,.,..,.but if EAD/AP is filed with AOS.,.,.,is there no extra charge?

That is correct. The OP will have to also pay $420 for form I-130, because his wife is adjusting from a tourist visa, and not from a proper immigration one, like K1.
