Hi,

Your profile says AOS pending. What kind of visa did you enter the US with? Was your AOS approved already? If you are already an LPR, your daughter can be petitioned under F2A, which is only taking about 2 years, so she should be fine. If you came as a K1, your daughter may be eligible for K2 status.

can anyone tell me if i filed i130 for my daughter who's 17 yrs old now and lives in manila, will she be aged out coz im only a LPR who just arrived in US but when i submit necessary documents i will have all requirements? ty in advance

Ok then, if your AOS has been approved and you received NOA2 for the I-485 that says welcome to the US, you are now an LPR, you can use this as proof to submit your daughter's petition. If you were given an I-551 or ADIT stamp on the passport, you can use that as well.

You do not have to and should not wait until your GC arrives to petition your daughter. As long as your AOS is approved, you are an LPR and the sooner you petition her, the better.

Like I said F2A category is about 2 to 3 years, so she should receive the visa before turning 21. You have to file the petition as soon as you can and double check everything for mistakes before sending to avoid an RFE. When you get to the NVC process, you want to pay the fees and submit the docs ASAP in order to make the process as fast as possible.

Same here :-( I saw someones profile yesterday who is also at CSC saying they approved her yesterday, PD is June 18 2014, so I guess we have a lot of waiting to do. So can someone please advise, lets say the priority date becomes current after NOA2, what are the chance that a visa number is available at the time of the interview? Thanks

Same here :-( I saw someones profile yesterday who is also at CSC saying they approved her yesterday, PD is June 18 2014, so I guess we have a lot of waiting to do. So can someone please advise, lets say the priority date becomes current after NOA2, what are the chance that a visa number is available at the time of the interview? Thanks

I thought if they scheduled the interview visa number was available? Isn't current PD=available visa number?

Really? I read somewhere on VJ that if the priority date stops being current while you case is at the embassy you do not get the visa. I hope that is not true. Do you think we can be fortunate to get our spouses here by August next year? I mean if PD becomes current after we are approved we can request NVC expedition.

I used an online calculator, and it looks like June of 2016 for September 2014 PD.

My spouse is a US citizen and he's here:) It's my 7-year-old brother that we filed for.

I don't quite understand how the PD can stop being current once it is. But it's my first time filing for a LPR relative, so I do not know much about the process.

I know, though, that the medical is only valid for 6 months, so if you don't get the visa at the interview, you risk losing your entry window.

I think when the case stops being current it's called visa retrogression, unless I'm confusing the two. But I have heard about people who do the entire process and on the day of the interview they are told that they have to wait more months or something because there are no more visas available.

I know. We were apart for a year and a half, although my husband is a natural born US citizen. Didn't even have internet, just a phone call once a week.
