hi! I am the beneficiary and I will have my interview in 2 weeks.

My fiancee and I are young and she started her job 2 years ago. She sent me her last 2 years tax returns.

In 2013 her income was 26,000 and I should be fine with that.

In 2012 since it was her first job her income was around 8,000.

Should I give the officer both tax returns or just the the one from 2013? ( along with form 1040, I have w-2 and 1099, bank letter and employer letter that she is employed).

You just needed a recent one which means tax return 2013. Just follow what the packet 3 was asked from you. Based on my experience, the lady who handled all docs asked W-2, tax return,and original I-134 (signed and dated).

She should include a statement in the form of a letter explaining why she didn't file in 2011. It's simple, she didn't file because her first job was in 2012 and had no employment or other taxable income in 2011.

As for the tax returns you will submit both the 2013 and 2012 returns. I suggest you get the transcripts online at www.irs.gov, it's much better since all the info from the return is all packed in there. If you can't obtain the transcripts right away online and can't wait for them in the mail, you have to make sure that you include everything that was filed with your original return, all schedules, forms, w2s 1099, etc.

As for her income, if it's just you two, $26k is enough. As long as she is making about $20k for a family of 2.

On second thought, you may not need the written statement about not filing. This is the I-134 and I don't think it's required like it is for the I-864. Of course, I don't think it would hurt to have just in case.

How long ago did she file? If she filed online more than 3 weeks ago, they should be available. If by mail it has to be 6 weeks ago. If not, you can use the full return. You only need the federal return, not the state, with all the schedules and forms that were filed. So make sure it's all there because if one is missing, it may cause an issue.

Tax return for 2013. is enough . I had an interview a week ago, and I only had tax return for 2013.
