- someone possibly hit the wrong button while updating your case online

- call USCIS and ask for a Tier 2 + make an Infopass appointment to inquire about it

- meanwhile, wait for whatever you might get in the mail. It might even be the notice of approval, for all you know.

- if nothing arrives in a week or so, contact your Congressperson and the Ombudsman.

I agree with this - I was sent a notification by text and email that was very confusing this week and the Tier 1 person only confirmed that information. When I spoke with a Tier 2 person the next day, they were able to say that there have been some issues with the database sending out digital communications. They said that the mail notifications are a slightly different system. If you haven't gotten anything in the mail, call them up on Monday and ask to talk to a more senior representative. It seems that the Tier 1 representatives only have access to the same database that produces the text and email notifications.

I also received an email, but nothing in the mail yet. I did recently open another inquiry about the processing time, but did not appeal anything.

It may not even relate to your case. They sent me an email about an RFE for my son that was meant for another individual. It was when I called a tier 2 that they looked into it and noted that the last digit was of my case number was different. Emails are sometimes sent to the wrong person. Check to see if the case number is yours. It really sounds like a mistake because you didn't appeal so that could not be referring to your case.

I do not think it is a mistake, not when you have been waiting for 10 months, which is unusual.

How does one have an appeal dismissed and a decision upheld if there was never a decision made or an appeal filed?

In my opinion, they confused your case with somebody else. Make an Info-pass appt and clear this up.

I would call the USCIS phone number and ask how it is that you were denied an appeal you never filed. I'd also check the status of your original K1 application and see if it is still active. If the agent you speak to seems confused then just call again until you get someone who can give you some information.

The whole thing sounds pretty odd. 10 months is still a pretty long time. Background checks that long? Our case took maybe 2 months with all the background checks etc. And i have to say that I have lived in 2 countries prior to moving to the US. They checked my background in the US, Germany and an ex-soviet country... did not take 10 months. You as a military member should not take that long to go through background checks regardless your rating, MOS or security clearance... unless you are a top secret clearance holder... that i can imagine could cause some issues. The military can make you cross rate/mos if you or your spouse have immediate family overseas... especially a country with kind of radical ways of making politics. This is just a guess and does not have to the same in your case... but its a possibility. The military is part of the DOD just like the USCIS is.

If you are a TS clearance holder, you maybe should consider this option. That would explain the long background checks on your fiancee. Nobody wants to let in a possible threat to the United States. Please don't take this personal in any way. I do not know anything about your job or your case, i'm just trying to help clearing things up :)

Please don't assume that it's your background check that took so long.. Your qualifications in the military do not play a role in how long your checks will take, everything is measured by the security clearance you hold. I hope that makes sense. Please correct me if im wrong.

One thing that has not been mentioned yet: The military help line of the USCIS! You call and usually get good information. You wont be talking to a sub-human. They sometimes can do some magic :) Calling wont hurt, hm?

I would call the USCIS phone number and ask how it is that you were denied an appeal you never filed. I'd also check the status of your original K1 application and see if it is still active. Nice thoughts, almost on the right wavelength,

but

OP needs to talk with an ISO, a Tier 2 Human. Not the first person that answers the phone, who is as useless as 100 year old toilet paper in a hurricane. Sure - can touch the surface, but not useful for cleaning up a mess.

An ISO has 'god access' on the computer, can see all. The CSR, the Tier 1 human, only sees what the OP can see online.

Just gave that a shot, although I'm not quite sure if I follow. Do you mean they may have accidentally updated my case as xxxx5 instead of xxxx4? There didn't seem to be any numbers nearby that had dates remotely close to today.

I feel like it must be a mistake because I skipped straight from initial review to post-decision activity. ???

IMO,

the whole 'thing' is a mistake,

because there is a report on an appeal that you never filed.

I claim data error, perhaps even human error that skewed the data.

It's simply wrong.

Get an ISO during the week, this upcoming week, keep drilling with them during that one phone call, insisting that you never filed an appeal; and that the status stored online is absolutely wrong.

An ISO can see more in their computer system, compared to a CSR. Still, must talk to a CSR to get an ISO, it's a PITA.

I was transferred from TSC to CSC a month ago. All of the transfers that haven't been approved yet received the same transfer notice we got in August again this past week. It was a glitch. I copied what one of the posters said when she called. You're not a transfer but I'm just pointing out that their system has been glitching & sending out uneccessary/wrong notifications. I definitely recommend calling & asking for a Tier Two officer. You need clarification & they should be able to tell you what happened. You didn't file an appeal so there's no way you could have had an appeal denied.

"I called and spoke two two tiers but they said there are glitches and that is the cause for the other transfer notice. They said they are switching systems. She also said that a case can be transferred "many" times depending on officers' work loads and that I might get an "a #" change notice (even though we don't have one) because of a glitch this week."

Thanks for all the great responses everyone. I think I've gotten past the initial freakout and it seems like the consensus is they made a mistake, although something about my case must be irregular.

First thing tomorrow I will use the military hotline (as I have the previous times I called) to speak to a tier II and see if an error has been made.

Next question though, is how quick is the USCIS to admit a mistake? My experience with the government so far has taught me that gov agencies "do not make mistakes", so I'm not too optimistic about this being a painless process to get corrected. Something that might complicate this issue: my fiancee has her B-2 interview this week, so I would hate to see her get denied for that due to a K-1 denial being in the system, even if it is a mistake.
