When I was a minor I was driving and had an accident and unfortunately someone passed away. I was later tried for vehicular manslaughter, as an adult, in youth court. I was not convicted of anything, there was a stay of proceedings and I have never committed a crime. Because this was dismissed and it was when I was a youth, I didn't think this was important to bring up, but after doing so much reading I'm getting nervous. We've already submitted our I-129F and are awaiting NOA1. I did not disclose this information but I'm starting to think that I should. At what point do I (or should I even) provide court documents? It does not show up on my background check, as far as I know. Will this prevent me from being accepted? My fiancé seems to think it's silly and I should just forget about it.

The I-129F doesn't ask about your background, that one is about the USC.

You will be preparing forms for your interview and they will ask specifically about it.

DS 230 part II Question 41. Have you ever been charged, arrested or convicted of any offense or crime? You must mark yes. Get the court records and get at least 5 certified copies you will need them for every step of the way. It does not matter if you know longer have a record when it comes to Immigration they want it.

Because of this you will also need to get your finger prints done for the police check.

DS-156 Question 38.

The first half of this question applies to you. so you mark yes.

Have you ever been arrested or convicted for any offense or crime, even though subject of a pardon, amnesty or other similar legal action? Have you ever unlawfully distributed or sold a controlled substance(drug), or been a prostitute or procurer for prostitutes?

K-1 applicants do not fill out the DS-230 or DS-156. They only fill out the DS-160.

Really wow I didn't know that changed. I know I had to fill them out. I looked at the DS-160 that one looks familiar also sigh been too long.

DS-160 has a similar worded question so regardless it asks and you must answer yes.

You always want to be truthful and have all documents as suggested above. I wouldn't worry though, because you weren't convicted so there shouldn't be an issue there. Anyone can be charged or arrested for something, that doesn't make them a criminal. Good luck.

Yeah, they replaced all the other forms with the DS-160 on Oct. 7, 2013.
