Problem # 1: I made mistake in I-130 for my sister and provided wrong date of birth for two of my nieces. My sister just got the ACL Letter from NVC asking her to submit 'Choice of Agent' form. How do I correct the DOB of my nieces now? Should I just send a letter to NVC along with their correct DOB and birth certificates? Or have my sister correct it when they Submit DS-260?

Problem # 2: With the corrected DOB- one of my nieces may be eligible (that would make her under 21) for immigrant visa. She is now in the US as F-1 Student. Will that be a problem?

Problem # 3: My sister now has a son who was born after I submitted I-130. How do I add him?

to answer your Problem #1, I had almost the same problem for my father's petition, I forgot the Jr. in his name...

You will need to email NVCinquiry@state.gov and be sure to include the following;

NVC case number,

Principal applicant name and date of birth,

Petitioner's name and date of birth,

then state your problem and provide/attach copy of the bio page of her/his passport to support the correct details.

You should call the NVC first and inform them of the issue, it may be possible they can correct it over the phone. If not, they will give you instructions as to what to submit and where. But do not worry, this won't be a problem to fix.

The DOB shouldn't be an issue, just have it fixed. However, since she is the derivative beneficiary and not the principal, I'm not sure if she has to adjust status, or travel back abroad to the interview. Hopefully, she can do AOS, someone may clarify on that later. But as long as she is under 21 and remains unmarried, she will be fine.

Problem # 3: My sister now has a son who was born after I submitted I-130. How do I add him?

When you call the NVC to tell them about the incorrect DOB, inform them about adding another derivative beneficiary to the case. They will tell you what to submit and where. Usually it's just an email with the BC attached.
