Is your wife from Mexico ?

What was her status before the aos ? Are you adjusting from another visa e.g. k1.

I found this link online might be helpful to you.

Great website! I like all the data it breaks down for you. One thing though--what would my EB Preference number be?

Also, this website mentions consular processing, but my wife and I are in the U.S. so our AoS is being done "in house" as we aren't applying abroad via a U.S. embassy/consulate. Does that make a difference in the calculations?

My wife is from El Salvador and adjusting from a J-1 visa.

I guess it would be ep1. Oh ok I know the time frames are diff depending on the prior visa. I came here on a k1 visa.

Im guessing your wife was not subject to a 2 year HRR on her j1 visa.

Also did you get married long after she came here on a j1 visa ?.

Does your wife have her ead? If yes a plus side to the gc taking so long might be that when your interview comes you may already be married for 2 years and get a 10 year green card.

My wife received a waiver from DHS for the two-year HRR requirement. I'm not sure if waiver is the correct term, but our lawyer submitted a request when we were engaged and DHS replied saying she could adjust out of her J-1 without the two-year HRR requirement given her upcoming marriage to a U.S. citizen and her clean record.

She entered the U.S. in early 2009, we met and began dating in mid-2010, got engaged and married in 2013, and filed for AoS in January 2014. My wife received her EAD in March, and with that she updated her Social Security card with her married name, got a state driver license, and we got her on my health insurance, vehicle insurance, a joint bank account, cell phone family plan, shared lease, et cetera. A good deal of our shared commitments and assets occurred before we were even married.

In our case, we are rather eager for the green card because we didn't apply for AP and she won't be able to leave and re-enter the country until we have the two-year green card, having overstayed her J-1.

Thanks! Out of curiosity, what's the longest you've seen? I believe I read on VJ recently that a couple received a letter indicating an interview about six weeks out. Has anyone heard of longer?

I actually my own case is one of the longest I've seen.

I received my interview notice on Aug 02, and my interview date was Sept 10. It's about 5 weeks and 5 days lol.

Ps. I was on "Testing & Interview" for about 5 weeks before I was officially scheduled for an interview. My location is NYC and this was a little bit faster than I expected. My friend in Atlanta GA waited for 7 months for their interview date, and their interview is happening 3 weeks later than mine, while they filed a few months earlier than me :/

Agreed, it's very unusual. We got married last year. Our priority date is in early January, we switched to "Testing & Interview" in February, and my wife's EAD production was in March. Since then the only thing that's happened is in August we updated our address on file following a move.

Our lawyer contacted USCIS and was told it's within the processing timeframe. Doesn't make a lot of sense but I'm not sure what else is possible at this point.

Geesh. Your reality is my exact fear! We contacted a lawyer back in March 2013 and received some really poor advice. As a result, we didn't file until June of this year, but I feel like we've been muddling through this process for a year and a half already. My hubby (from El Salvador) received his EAD a month ago, yet he's still listed under "acceptance." There's no evidence of movement to "Testing and Interview" at all. I fear that we will be in the same position as you. I can't believe USCIS won't talk to you until October when the true "6-month" process dates are posted. Best of luck with everything!

Wishing all of your luck on your immigration journeys.

I seem to be an exception. Are you self-filing or using a lawyer? If you have no red flags I would just sit tight and hope for the best. Does your husband have AP?

We filed using a lawyer. And yes, he got his AP when he got his EAD a month ago. It's just hard hearing how people that filed after you already have their interview date.

True. Have you compared yourself to other cases in your field office? Some regions have much bigger backlogs than others.

  • 2 weeks later...

I want to update my question and say we recently received our interview notice, with our interview being scheduled exactly five weeks after the date our interview was set, and four and a half weeks after the USCIS website and notifications were updated to display that.

Congrats

Thank you. If we receive the green card a week or two after the interview, it will have been ten and a half months from our priority date, which is much longer than the average VisaJourney case that I've seen.
