Jose Padilla, a former Chicago gang member convicted in a "dirty bomb" terrorist plot, was re-sentenced to 21 years in prison Tuesday after an appeals court deemed his original 17-year sentence too lenient.

Federal prosecutors agreed not to seek more than 30 years in prison for Padilla as long as his lawyers did not introduce records related to alleged harsh conditions he endured during the 3 1/2 years he spent in a South Carolina military prison.

Under his new sentence, U.S. District Judge Marcia Cooke ordered Padilla remain in a super-maximum security prison.

Padilla, an al Qaeda recruit and the first U.S. citizen deemed an enemy combatant, was convicted in August 2007 on charges of conspiracy to murder, kidnap and maim people abroad, conspiracy to provide material support for terrorism and providing material support for terrorism.

His re-sentencing has been delayed many times by Cooke as lawyers wrangled over his long criminal history and shared thousands of pages of classified documents.

Padilla was arrested in 2002 as he returned to Chicago from abroad, where prosecutors said he spent time at a military training camp in Afghanistan.

He was accused of plotting to detonate a radioactive "dirty bomb" in a U.S. city but was never charged with that. Then-President George W. Bush ordered him held as an enemy combatant and interrogated in a South Carolina military prison.

Prosecutors later argued Padilla deserved a life sentence for his 2007 conviction but Cooke rejected that sentence because Padilla did not commit acts of terrorism on U.S. soil, or attacks on officials or a plot to overthrow the U.S. government.

An appeals court ruled in 2011 that the 17-year sentence he ultimately received was not severe enough.

In a 2012 appeal rejected by the U.S. Supreme Court, Padilla said he was held in isolation for more than three years at the military prison, shackled for hours in painful "stress" positions and subjected to lengthy bouts of blinding light followed by total darkness.

He has been held in a super-maximum security prison in Florence, Colorado, awaiting re-sentencing.

As he was being released from an American detention camp in Iraq in 2009, the man who will go on to head the powerful ISIS group issued a menacing warning to his former captors.

'I'll see you guys in New York,' Abu Bakr al-Baghdadi reportedly told U.S. Army reservists from Long Island who had been guarding him at Camp Bucca near the Kuwaiti border.

Army Colonel Kenneth King, who was the commanding officer of the U.S. forces' largest detention facility in Iraq in 2009 was one of the people who heard al-Baghdadi’s parting words, but he did not take them as a threat at the time.

i think he would give both nuts. i think there's lots of folks that want to pull off an attack, on ny, anywhere. and they can come in from anywhere, don't limit yourself to the southern border.

I do not live in fear. A terrorist would not be interested in my area. No bunkers .. What I am aware is what an attack would do on this country. .. Part of my living is in commodities and a hit on this country could be a massive hit on this sector. .. Because of 911 my mother will get half molested every time she fly's ..Children ,old ladies,,, WW2 veterans that have put everything on the line for this country are suspect. when they want to travel, What would another attack on US soil do to the loss of a normal lifestyle. A quick trip to NY City with a truck could be a nightmare... How about every truck being searched trying to enter. You saw what happened to your police force in Boston during the days following that attack. Business sectors would fold.thanks to .. (just in time ).. Our borders are not secure and the folks that are responsible for that security are changing the diapers of future undocumented Democrats. You have a man in Iraq that commands an army with more resources than any other terrorist organization in a long time. You have a leader that I believe goes to sleep at night with a goal to bring great anguish to the folks that had great control over him at one point in time.....
