Hi,

I am planning to start the GC process for my mother (widow) - IR5. She lives in India. Due to time requirements for documents procurement, I have the following questions spanning the whole process.

1. If I file I-130, how long will take to get the approval NOA2.

2. How long can we assume the whole process with Visa in hand

3. While looking at the DS260 sample, they are asking for previous Visa details. (My parents visited US 17 years ago for 6 month trip). We do not have Visa number. But, we have visa issue date. We can not find that passport either. Will it cause any issues ? Is there anyway to get that information from USCIS.

4. My parents applied for another Visa in August 2005. That time the consulate at New Delhi instructed us to go to Chennai - with a stamp as application received on the passport. We did not receive any paperwork to say it was denied. How do we answer this. should we treat as Denial and give details. My parents did not bother to go to Chennai as my father's health did not permit them to come to USA.

5. Should we obtain police certificate from all towns my parents lived - even though they are livinng at current city for the last 10 years. Or 1 police verification from passport authorities good enough ?

6. Do we need to submit my marriage certificate if my income alone is good enough to provide affadavit of support.

7. Her interview is most likely to happen in Mumbai, India. She is not fluent in English. Will they offer an officer who can speak Telugu.

8. How long does it take to get the visa stamped after the interview.

About 6 to 8 months, hopefully. The timing can vary based on the workload in the service centers.

2. How long can we assume the whole process with Visa in hand

About 1 year, usually. It can be less or longer, depending on several factors such as but not limited to, NVC workload, USCIS workload and how soon you gather the docs pay the fees, embassy workload.

3. While looking at the DS260 sample, they are asking for previous Visa details. (My parents visited US 17 years ago for 6 month trip). We do not have Visa number. But, we have visa issue date. We can not find that passport either. Will it cause any issues ? Is there anyway to get that information from USCIS. Do not worry about this yet because this is filled out online after the case is at the NVC. Also you answer the application as truthfully as you can, don't put an exact date if you're not sure. Just be ready to explain this at the consulate. They look these things up so don't be concerned if they no longer have a visa from that long ago.

I would have to see the wording on this question, but again you just answer the truth, that you're not sure or don't know. Again, they look these things up anyway so don't be concerned if you don't know.

Or 1 police verification from passport authorities good enough ?This depends on whether the police certificates report the information throughout the country. For example, here in the DR, one police certificate covers the period you lived anywhere in the country so there is no need to obtain one from every city. So I don't know how it works over there and you would have to find out if the police certificate covers the entire country or only certain districts.

6. Do we need to submit my marriage certificate if my income alone is good enough to provide affadavit of support.

I'm not sure what you mean here. The marriage certificate doesn't have anything to do with the I-864. If you mean that you will not be combining your income with your spouse, then you just have to prove your share if the income. However, since you have to include your spouse anyway as part of the household size, the more income you have the better. Now according to the DOS website, you will need an original or certified copy of your marriage certificate sent to the NVC.

7. Her interview is most likely to happen in Mumbai, India. She is not fluent in English. Will they offer an officer who can speak Telugu. They should have someone that can speak a common language, I'm not sure about how many. Pardon my ignorance but is this the most common dialect?

8. How long does it take to get the visa stamped after the interview. This varies on the consulate and whether or not they have to do administrative processing.
