Timeline

Got my immigrant visa 8 months ago .. came to the states .. everything was alright .. but my wife told me a month ago that shes not going to apply for my 10 years gc for no reason .. then she statred making problems . She disconnected my phone snd gonna withdraw the sponsorship. We have been married for almost 2 years and half . Now what should i do .. feed me back please . Thanks everyone

She cannot "withdraw the sponsorship" after the green card is issued.

Her consent is not required for you to file for and obtain an unconditional ten year green card; you can file on the basis of a divorce waiver if necessary.

You should probably investigate the underlying reasoning though.

Do you have a conditional green card?

If yes, then she is SOL. She can not withdraw her sponsorship.

Is your marriage over, or do you intend to try and work it out?

If it's over, then you file for divorce and once the divorce is final you can file for your ten year greencard (form I-751) with a divorvce waiver. Make sure you gather as much evidence as possible of a bonafide marriage before splitting up.

What do you mean by conditional green card ?? I have the 2 years grean card yes . I got it 6 months ago .

The 2 years green card is a conditional green card. You must file to remove the condition in order to maintain your status. Failing to remove the condition means your status will end when the conditional green card expires.

Do you know what removal of conditions is? If no, then you need to learn about what you need to do to stay legal in the US. Start by reading the guides.

You wife cannot withdraw "sponsorship" in the sense of the I-864 that promises that if you receive need-based public assistance, she will reimburse the government. That obligation ends only when you have earned 40 quarters of social security coverage, become a citizen, or you lose your green card.

At the 2-year mark for your green card, you will have to file for Removal of Conditions. This must be a joint petition unless you are divorced, or claiming either extreme hardship or physical or mental abuse. There is some doubt about whether you must actually be divorced or merely have filed.

In any case, you must show that you entered the marriage with a good faith intention to have a bona fide marital relationship. It does not matter whether she had such an intention or not, nor whether you continue to want to be married - all that matters is your state of mind at the time of marriage. Of course USCIS will infer your intentions from your actions since they are not mind-readers. The most important things to document to show your good faith intention are that you lived together or tried to, and that you co-mingled your finances or tried to.

You should therefore accumulate as much documentation of those two things, as well as other items mentioned throughout this forum. You said nothing about your relationship prior to moving to the USA. Assuming that you tried to move to the USA and live with your wife as promptly as was reasonable under the circumstances, and that you behaved as though you intended for the marriage to work, you should be fine.

Let's say, an extreme case, that you move here having done everything reasonable to that point to have a bona fide marriage, and the day you arrive your wife says "You know, your clothes really smell and I can't stand the food you eat and I just don't want to be married anymore." That (in theory) has zero relevance as to whether you acted in good faith. (If you were the one with the sudden change of heart it would in theory also have no effect, but USCIS might wonder if this "change of heart" was planned all along as soon as you hit the port of entry.)

The main thing you should do now is start collecting the necessary evidence, which you will need when you file for Removal of Conditions.

And i still have an email from her sent to me a year ago before i come to the states shes asking for divorce cuz she dont want to wait .. then she changed her mind again .. so the divorce idea is in her mind since long time ago . Would that help me too ?

Nope, those emails are not considered evidence. You need these things for your I-751 with divorce waiver

- Divorce decree

- Commingling financial evidence: bills, insurances, bank statements, tax transcipts... covering all your marriage period

- Affadavits from persons, who know about your marriage

- All other evidences can support your case, even the smallest ones

If your evidences are good, you will not have an interview. Otherwise, an interview will take place.
