What doesn't break us will make us stronger. I always believed in that. I'm sure anyone going through the NVC ordeal recently, is experiencing a newfound affirmation of love and kinship to his/her spouse/family.

I'm sure we'll cross paths one day as long as we stay in touch.

Thanks romii. It's an employment visa tailored for scientists and artists who could prove they're leading experts in their field, hence it doesn't require a prior job offer and can be self-petitioned... called EB-1A. I had to educate the CO on it to reverse his denial decision on the spot.

Oh I would be fuming if I were in her shoes too!! Keep us updated! Fingers crossed all is resolved soon!

Presumably, the consular officer stopped reading at EB-1 and missed the A?

I'm the USC petitioner. My wife is British (now a USC!!!), generally awesome, and amazingly patient.

What I was told is it can take up to 30 days which Is why I said to the Rep, now way been waiting way over a year have been stuck in limbo every step of the way up to this point no I need to talk to a supervisor please and I got one. :D So one week if you call and let them know how long you've been in this nightmare or up to 30 days if you do nothing. :D

Am just filled with tears reading all the kind and sweet words of encouragement from you all. I am blessed to have people like you in my life, I swear I don't know what I'll have done on my own. You all are God sent.

Yes it really hurt going thru this immigration but I feel relief knowing I have people who understand and know my pains. God bless you all.

**Hubby said if he has to call everyday to get NVC to correct their mistake that he will. He will be calling everyday to get positive result.

**I think it will be a good idea to meet great and wonderful people like you all when we all are finally in U.S**

Not LPR per se, but the IV you got last time is your last visa, unless you got an non-IV issued recently. As for last 5 US visits, I'm not sure... logically, from POE date till last exit from US that terminated LPR status should be a single "visit". However, I'm guessing background checks will utilize the CBP electronic entry/exit logs which means you should list the last 5 trips to the US regardless of status.

Please let us know when you find a definite answer.

I had the same chest/heart pain for months after my wife was diagnosed with cancer. At one point, my left arm went numb as well. Fearing the worst I went to the ER and had EKG and was reassured of good heart health. Turned out stress does that to you sometimes. Definitely go to the ER if you feel left arm/shoulder numbness or shortness of breath.

I am in a similar situation with my mom. I listed all POE entries. She got her green card while in the US, so she didn't have immigrant visa number, just an A# and I listed that. Then I was as detailed as possible about her situation, entries in the US as a visitor and then as a LPR, since she was declined a visitor's visa in 2013, after she was not approved for returning PR. I am sure all this will come up during the interview. Best of luck and speedy CC!

MoBar65: i adjusted status in the US so never had any visa number, just an ARN. I just listed everything. I figure if i'm honest and list everything I can't be accused of misrepresentation.

meg_654: Isn't it just awful having to go through this again? Adjusting status in the US was so much less stressful than this. It sucks having made a home somewhere and then not being permitted to go back without a new visa. I think they need to renew these policies and have different rules for family LPRs compared to LPRs who gain status through employment. But that might just be me!

Sure he did. He even showed me his adjudication field manual full of highlights. He was just on the wrong page. It can be confusing, especially to a CO who rarely sees any employment-based cases come his way. There are EB-1 to EB-5 and within EB-1 there are EB-1A to EB-1C. Only the extremely stringent EB-1A doesn't require a job offer and can be self-petitioned.

Guys we received my AOS checklist email today for Part 3 item 7 and the checklist was in the name of the petitioner.. We have a joint sponsor. When we checked the petitioner's (my wife) I 864 we found that Part 3 item 7 was correct. When we checked our joint sponsor's form we immediately noticed that Part 3 item 7 was wrong. Instead of 1 my joint sponsor had mentioned 0 in Part 3 item 7. So we corrected my joint sponsor's I 864 and will be mailing it today. My understanding is these days even the names on the checklist's are messed up and we need to apply logic while sending in the corrections....

I knew your AOS was correct that was why I said you should speak with a supervisor but I didn't know you had a joint sponsor. So sorry about that, its just a little mistake and NVC would have allowed you bring the corrected form to the interview. SMH for NVC

It's official... I had a Hat-trick today... third AP in as many consecutive visa applications !!!!

Had the most grueling interview today. Arrived at the embassy at 12:30 and left at 3:00 pm. The CO interview alone lasted over an hour and a half !!! Half way through the interview the CO was about to reject the application citing a missing requirement from the petition (a tenure-track job offer). I had to painstakingly convince him that he was citing the requirements of the wrong visa category altogether. Once that was squared away, I had to walk him through my 14-page petition letter and all the evidence contained in it which exceed the requirements of the correct petition category. Glad I had a duplicate of everything I submitted... it was like one of my lectures... CO said as much jokingly at the end.

At the end, we reached a compromise that I provide a fresh letter from CU-Boulder that they are expecting my arrival and are providing their research facilities for my use (received a 221(g) letter detailing this request). I had a formal letter to that effect from CU-Boulder, but the CO wanted a reaffirmation !!!

So drained now... I need to rest before I contact CU-Boulder.

I am so sorry for your delay. But goodness you know your stuff and at least stood your ground good for you.

Rest and get that letter to them.
