i was interview last month for CR1 visa and consular officer ask me the person who submitted AOS is already gave many AOS and his income is not enough.so i again submit new AOS and i calculated new sponsor income meet poverty guide line 125 % requirement and this person just gave only one AOS but along that person income was sufficient but again embassy call me and ask me same answer.

here is my calculation.

house hold size is 7 excluding me and poverty guide line for 7 is 45,037 and i am attending immigrant and if i include then i add 5,075 and the its equal to 50112 and MY sponsor income is 52000 so PLEASE TELL me why embassy say this that income is not meet and he already gave one person AOS. but i include that person in household size and it was 7 and 8 number for me.please guide/

Its possible the household size was not calculated correctly, and that is why the income is not sufficient. How did you figure out the household size? For household size, you must include the following:

  • YOU, the intending immigrant
  • Your sponsor
  • Your sponsor's spouse, if married
  • Your sponsor's unmarried children under the age of 21, whether or not they live in the same house and whether or not they are claimed on taxes. You can exclude the children if they have reached the age of majority in the state in which they live and they are not claimed on taxes.
  • Your sponsor's dependents listed on their tax return.
  • Any previous affidavit of supports that the sponsor has filed, and still has an obligation. This means ALL previous affidavits of support that are still binding.

Your primary sponsor will be your husband, is this your only sponsor? Did your husband file previous affidavits of support? If so, then the problem may be related to the previous affidavits of support. You may need a joint sponsor if you don't have one.
