H1B about to expire

Hi everyone

I filed for AOS on July. Completed Bio and currently waiting for interview along with EAD and AP.

My H1B i-94 expires end of this month. I am looking for suggestions on next steps cause I don't want to stop working or lose my job.

Are any of these options valid? Are there any other options?

1. Call USCIS to expedite the EAD

2. Apply for H1B extention through employer - (not sure about the fees/expense)

3. Stop working after the H1B expires and wait for the EAD to process (this is actually not an option at all).

Presumably your Employer knows your H will expire soon, why are they not doing anything?

Checking on best option for me before I ask my employer. They are waiting on my follow up.

I would vote for 1 and 2 as 3 is not an option.

1 and 2 are no cost and good insurance.

Yes. As mentioned definately one is your best choice. Not sure how long number two for the extension would take.

However, If you filed EAD with AOS in July you should be receiving it soon. Many people in the July timeline have received it or are in the process of receiving it now.

Yes to all three, with regards to the last the Employee dose not pay.

If I were you I would get on expediting your EAD right away. It can take anything from 7 days and up. Normally done withing 10 days if everything goes super smooth.

When expediting, be really detailed. Make sure you tell USCIS it's because of financial stress and that you have proof in form of letter from employer stating that you will loose your job unless you get an EAD approved and how much your annual/monthly income is.

Have the rep read back his notes in your expedite request. Make sure all that info is in there. Make sure they add both your phone number AND your email address so they can request the proof you mentioned in the note.

Check back every two days on status for your request to make sure they didn't mail you a hardcopy request for supporting document. If they did, that will delay it by a week. You can request them to read the info in the hardcopy over the phone - where you will get the attn details and the fax number to fax your letter to.
