E3 visa with a IR-1/CR-1 pending

Timeline

I am currently at the NVC stage of my IR-1/CR-1 and my employer has expressed interest in sending me to the US on a E3 visa. While i understand that this not a dual intent visa, can I do the following


-->obtain this visa


-->Go to US on it


-->when its time for my interview return to Australia, and complete my interview


-->Re-enter the USA with my shinny new green card



Technically I am not using the E3 as a stepping stone to Migration just means to work and be with my wife in the US until I get my interview.

Good question. I'm not sure if you are able to get a work visa for the first time if you have a pending family petition. If you can, would you be able to get this visa before you receive your immigrant visa? Hopefully, someone here would know more about this kind of situation. I know for a fact that if you already had the visa, you would have been able to do AOS.

E3 visa are issued very fast, in days actually. So if i get an offer from my Company I could potentially be on US soil in 4 weeks.

That's good. But I'm not sure how it plays out with the pending petition though. Let's see if someone may know how it works.
