Hello! Please help with this application:

I am US citisen and I want my mother to be a permanent resident.

Exept the form I-130, I need I 864.

I cant meet the requirements and I need a joint sponsor (the joint sponsor is not a relative of me or my mother).

- do I have to fill up one application from my name and one I 864 from the joint sponsor name? or only the joint sponsor?

- What I need to mark in Part 1? And what the joint sponsor need to mark?

On more question: My husband is reciving unemploement from April. Should my husband fill up I864 with the joint sponsor?

Hi,

Are you at the NVC stage already? Because if not, then you don't need to submit the I-864 with the I-130 unless your mother is in the US and will adjust status. If she will be applying for a visa abroad, the I-864 is not need at this time.

When you do need the I-864 it will be one for you as the petitioner and another one for the joint sponsor. The joint sponsor doesn't have to be related in any way to any of you, so don't worry about this. They do have to be a USC, US national, or LPR and they cannot combine their income with you.

I also don't understand your last question. Your husband doesn't need to fill out an I-864 because you are the one petitioning. Unless by combining his income with yours you meet the poverty level he would need an I-864A, but I'm not sure if ui benefits qualify for AOS purposes.

Since you will be using a joint sponsor, it's not necessary to include your husband if you don't need to.
