Hi,

My wife and I got married in November of 2013, and started filling out the AoS forms in January.

We've had them all signed and dated since January, ready to go, and have not yet submitted them because I have had multiple setbacks with documentation (lost passport, trouble finding a copy of my birth certificate, etc). As my wife was a student at the time, her Dad acted as a joint sponsor and filled out the forms. They are signed and dated from back in January.

Now we are finally ready to submit, but I am worried about the dates. Will the fact that we've passed into a new tax year be an issue? Her Dad has supplied tax forms from 2010, 2011 and 2012, but not 2013 as they would not have been relevant when he prepared the documents.

Should we just explain this on the cover letter?

Alternatively, my wife has recently got a job that would allow her to financially sponsor me. However, this was only in the last few months, so we don't have any tax evidence. What do we do in this situation - how do you prove you can sponsor if you've only recently become capable of doing so?

You should submit a new I-864 as well as updated supporting documents. Your current I-864 is over 6 months old, and this needs to be as recent as possible. You will also need to submit 2013 taxes as that is the most recent tax year.

You can submit an employer letter and pay stubs to prove current income.

Would that be enough?

Her last 3 tax returns would be extremely weak - would pay stubs and an employer letter be enough to prove to them that she can support me?

What happens if we send it in and they decide her affidavit of support is not enough, as there is not enough proof of sustainable income?

Thanks for your help, I'm just in a panic.

I think you should still have her dad as a joint sponsor and of course your wife's affidavit of support with this new income detailed in. Have him refill his affidavit of support and include his 2013 tax returns. If nothing else has changed, reprint your signature pages and sign again with the current dates. Don't forget the medical examination form I-693.
