Hi VJ Friends. I have a different case in which I am helping out, my cousin. Her dad submitted her papers for I 130 about April 2013. Now, we checked on uscis.gov for status and it says Post Decision Activity, informing us that we now need to check on the Department of State for its status. We went to ceac.state.gov under visa status to check and it says No Record Found. What do we do in this case?

Now, according to my cousin, her father has not submitted the Affidavit of Support form because he doesnt meet the requirement and he doesnt want to accept help from no one. She is in the Dominican Republic. Is there a way she can call from the Dominican Republic to check what is going on? Because it seems he is not being honest. Also, can she submit Affidavit from some else who is willing to help?

I know it sounds very confusing and unreal, but sadly, it is a true case.

The petitioner must also be a sponsor even if a co or joint sponsor is used. She cannot get around this if the petitioner (her father) refuses to turn an I-864. This side of things is pretty much dependent on the petitioner to do their part. If they refuse to, the petition is stuck.

ditto, she needs her father to petition for her. the petitioner is the primary sponsor, even if he doesn't make enough, he has to file an i864 and find a joint sponsor or co sponsor. Unfortunately there is nothing she can do if he refuses to continue the process, unless she can convince him to change
