Any advice on permissions needed for my alien fiancée’s daughter

Hello,

I am wondering if anyone has any practical advice on permissions that could be necessary or useful from my fiancée’s ex husband for their daughter.

I am the USC and my fiancée and her 8 year old daughter are Mexican citizens still in Mexico awaiting the K1 & K2 visa process.

Both of them have Mexican passports that were renewed in the last year. To get the passport for the 8 year old daughter her ex husband did go with her to the embassy and sign whatever was needed for the passport.

But is there other documents or affidavits or permissions it would be good to obtain before my fiancée leaves Mexico?

I am 99% sure my fiancée has sole legal custody of her daughter but the husband and his side of the family have been a part of the Childs life.

The advise I need is from someone who has gained a stepchild through marriage and has suggestions on affidavits or documents needed for the step child in the life after this immigration process.

My soon to be step daughter will retain her fathers surname which is different from the surname her mother uses.

I am thinking in the future that there may be times it could be necessary to prove I am her step father and guardian.

Like suppose I go to pick her up from an after school class and the teacher doesn’t know me and wants me to prove I have legal right to pick up the child?

Will I or my fiancée need some sort of document (in addition to a passport) to take the child traveling outside the US like into Tijuana and back or the Caribbean?

If my step child has some sudden illness or injury and her mom wasn’t right there with me to give medical permission, is there any legal right I would have to speak for the care of the child or would I need some kind of document signed by the mother and father saying I am allowed to choose the child’s medical care?

My fiancée works for a company that may afford her periodic business trips within the US and so it is possible there might be 2-3 weeks or more a year where I am the sole guardian of the child.

Will I be considered a legal guardian just by the fact of marrying her mom?

Can the mom just leave me with a notarized note that says I am the guardian and permission is given to make medical decisions?

So really my inquiry is all about practical advice after my fiancée and her daughter arrive.

Is there any documents or agreements you might suggest I have her get with the ex husband while she is still there in Mexico?

Any advice would be helpful.

Thanks, Rudy :dancing:
