I am a US expat living in the Philippines. I will be here for at least two years. I want to marry a Filipina in the US. She has never been married but does have a 3 year old child here in the Philippines but the child is a US citizen as the dad filed birth abroad and is a US citizen and lives in the Philippines. I want to take her to the US to marry but we will come back to the Philippines to live. What type of Visa do I need and where do I get started? She has primary care of the child but the child does have the fathers last name. She has court orders with outlined child custody. She was never married.

We do not plan on moving to the US. at least not know. We just want to get married there. I am working for a global company here in the Philippines and she lives and works here as well. How hard will it be to take her to the US to marry? Where do I go to start the process?

You may be able to get married and do direct consular filing. However, if your fiance becomes an LPR, she will need to live here in the US to maintain her LPR status and I believe you have to have the intentions of returning to the US in order to get her a visa as her sponsor. I'm not familiar with DCF, but there are plenty of others here who are. If it turns out that you are required to move back to the US, then I would wait until that time to get your fiance a visa. Again, someone here with more knowledge about this process or your best course of action can clarify further. Good luck.

If you just want to visit the US to marry only a tourist visa is needed. Usually she will need to show ties to her country but in this case I think if you interview together and you show your ties to the Philippines as well and explain you only wish to marry and return it might work out. As to the child you would need the fathers permission usually, but for only a visit to the US it shouldn't be a problem. But his written permission that the child is being permitted to leave the Philippines for XX number of weeks might help show the intent to return.

Why bother coming to the U.S.? Why do you want to get married in the U.S. instead of marrying in the Phils?

Just get married in the Phils and enjoy your life if you don't plan to live in the U.S.

Being you are not planning to live in the U.S. she could try to acquire a tourist visa, then you could both fly there to marry, then fly back. Tourist visas are not the easiest to get but they do happen.

To get a K-1 fiancee visa being you need to have domicile in the U.S., and other requirements (of course) - but this would be a waste of money and time just to get married and fly back to the Phils

Seriously I am really confused as to the "need" to marry in the USA.

Just marry there, then when you are ready to move to the U.S. do a DCF (Direct Consulate Filing) for the CR/IR-1 visa, that is the quickest... for later.

She'll need a visitor visa.
