Thanks for the welcome. You know I think I've come to the conclusion that the farther you get in the process the higher the stress level(cause and effect, direct correlation, you name it). I also don't think that there is anything that can be done to really lower either. The process just has to run its course. No two cases are alike and things can happen along the way to change everything that you thought you knew. What a revolting development that is! Just have to keep smiling and keep each other company through the ordeal. :thumbs:

Hey, everyone! Just wanted to pop in and say hello. I just want to hear some good news for you, Beetee!! An RFE at this late stage sort of stinks, doesn't it? Although, maybe not. It's probably really good news. Have you begun to pack and sort things out yet? Are you all ready to go? I really hope things work out well for you.

And, Vicky, aren't we almost to your case? I can't believe we're halfway through August! Unbelievable.

I don't know if you all are wondering what is going on in my boring little life or not, but I'll share anyway. I'm feeling much better about the whole thing. Still sort of bitter about the whole denial, the unfairness of it all, but not letting it consume my thoughts or bring me down in any way. Cas and I didn't make it as a couple, but we're managing to stay friends. I still love him, but there's really no feasible solution for us to be together in any country! I guess love does not conquer all. He was worth the risk, though.

Anyway, glad to hear that you are doing well in wedded bliss, Paul! That's a fantastic bright spot.

Good luck to you also, Mary. You deserve for good things to happen for you both.

Good to hear from you. I'm still so sorry things didn't work out for you two but it sounds like your dealing with things ok. It's good that you two can stay friends after all of this. Just stinks that it had to end up like that.

Yeah we are getting close. From what I can figure out by that silly list (they had a major overhaul last week) we should be about number 4 on the list now. I'm starting now to get a little impatient. The closer our time comes the more it bothers me. :lol: I really hope they just surprise me and complete the case without going to under review but I doubt we could be that lucky.

Beetee will hear something very soon. We will be watching Wednesday for sure to see if she gets here completed then. They better do it soon, I think all her nails are gone and 1/2 of her hair is pulled out now. :yes: Aww but she will be fine.

Sounds like everyone is doing well, and Tiff - it's great to hear from you again :thumbs: Yea, it's amazing that it's almost Vicky's turn.... she used to be longer down the list until they changed it - but she is at her 11th week now, so she might be completed any day now.

Yeah beetee I don't think they will change it until Wednesday. Seems like Wednesday and Friday are the days for now.

Dang it I swore I wasn't going to let it start to get to me but I think it is now. I'm getting a little fidgety and squirmy now. I can't seem to concentrate on work. Never could much before but now it's worse. :lol:

I'm soooooooooo ready for all this to be over with. Well this part of it anyway.

I sure don't blame you for going a little nuts. Maybe we will both end up in the looney bin. :lol: Good thing we don't have to take a mental evaluation while all this is going on.

Hello everyone! Well for Mary what I did with my car when I left was leave it with my brother and he sold it for me. My whole family is in the states parents, 4 brother and sis. I had alot of people think I was crazy to move here for John but in the long run they all miss me now. Especially my young niece and nephew. They don't understand why i don't live down the street anymore. They understand a little more since they had a really long flight to get here for the wedding. I had about 10 people come over from the states for the wedding and John's brother came too. His brother is a US perm Resident. That's what makes it the most tough on him. He worked with him, live next door and hung out with the same crowd. Anyway!

John's cousin just got back from Canada. Of course she married a Canadian and she is British. She said even at the airport here in little ol' New Castle, England she said they were a little strict. She only could carry her wallet and passport...no purse nothing. They threw away her eyeglass case. She said a woman next to her had a baby and they took all the baby stuff except for the formula. She said for her husband to get through immigration and their eldest son (he is canadian) it took over a hour. The airport is tiny too. Kind of scary all of this. We are going on our honeymoon in a few weeks. Only to Greece though, so I am sure it will work out fine but still, now I am having awful dreams.

Well I started to fill out all this paperwork to start the process over again now that we are married. All of this is scary and I am already being pessimistic and haven't even sent the papers in. I was talking to some people on some other forums and of course they don't know my whole story and it gets really frustrating. They have to tell me you have to prove extreme hardship and then it brings me down again. I have already started asking friends to start thinking of letters to write for the waiver and everything.

Well if I ever have questions on what I am doing can you guys help? I feel more comfortable asking my 601ers!!! I know I haven't been around lately but you guys really helped me through a tough time. Sorry for rambling.....

I see you got your remain to settle visa. I was wondering about name changes. Did you take your husbands name and, if so, what have you done about your name on your passport etc.? I am guessing that the remain to settle visa is stuck into the passport the same way the fiance visa was? Do names have to match or do you get a new passport in the married name first or what?

As for your paperwork, I guess I am mostly concerned about the fact that your waiver was already denied. why would it be different now that you are married? I am confused. Wouldn't their reasoning still be the same? Please don't be upset with me, but I hope you have considered that you might have to stay there ... I hope you are prepared for that possibility and are determined to be happy either way.

Hi jpkeswim,

Good to hear from you. Sounds like you have been busy getting settled in. Sounds like a lovely honeymoon to Grease. Try not to worry too much. I'm sure it is safer now that it has ever been.

I remember your waiver was for an overstay. It ended up being a 10 year bar wasn't it? I was just wondering how long into the 10 year bar you were? I would think the more time that past for the bar the better your chances would be. I know it's tough getting started on a new harship letter. Now that you have moved over there it's going to be hard to prove you can't live there. Well dig down deep and write a letter of a life time. Use everything and anything that might help you. If you have anything that we can help with I'm sure we will chime in there and do whatever we can. If anything we can make a few suggestions. That hardship letter was the hardest thing i've ever had to do. It didn't come easy for me. Heck I don't even know yet if it was good enough. :lol:

Hope you have a great honeymoon and let us know how everything is going and maybe some of us can help out.

Yes I took my husbands last name. They told me at the Home Office when i want to fly just to use my Maiden name with all my travel documents. They said if you want to be very safe you can bring your marriage cert. too. They said it would be no big deal just to make sure when making travel arrangements to make them in your maiden name.

Yes we understand that we might have to stay here for another 9 years but we are hoping that it won't be the case again. In the denial letter one of the reasons of our denial is because we weren't married. They stated how do they know if it wasn't for his mother dying would we actually be getting married. We had already planned to get married when everything happened. That was one of the main reasons for the denial. We might even have our lawyer help us with the waiver letter again. He told us when we last talk that there was something that the American Bar Association has issued a statement with regards to long term undocumented residents who were brought here as childern. ( Which was his case) He really didn't go into detail so I will probably try to research this online. Maybe I will have some luck.

Well in March it was one year since he had been refused entry. So it has been about a year and a half. I know that letter is going to be tough. We don't have any kids so we can't say that is a hardship and my parents are healthy for the most part. My mom does need knee replacement surgery but hasn't done it cause she has no one to take care of her. (Ahhh I might be able to write about that) My grandma's are old. But they don't live down the street or anything. It was the sadest thing...my one grandma called and wished me luck the night before the wedding and started crying to me wishing she was here. I had never heard her cry in my lifetime. She always puts on a tough act.

Well I i will have plenty of time to talk about all this in the next few months. Sorry for rambling again...it's a boring night. My Husband is at work.....

Kind of sucks about the name for me... my current name is that of my ex-husband. I wish I could drop it completely. I was hoping there was a way to get my passport changed before getting the settlement visa. So its not really the same as you making travel arrangements in your maiden name. I will have to continue using my ex's name :(

This may be the wrong place to ask these questions but after reading thru many pages of previous posts I thought I might get some information here.

My Fiancee and I, have just recently gotten our NOA2 and now are waiting for NVC to forward our petition to London. (we got caught in the IMBRA mess). My fiancee has a previous overstay of 7 years. So we know we will require a waiver and have already written the hardship letter and gotten the supporting documentation. I have done a lot of research on the subject but after reading some of the denials I do have a couple of questions. Now I know that each case is different and that no one can give me a definite answer but am just looking for some opinions and past history to give me a better idea of our chances.

My understanding of the process and decision to whether to approve or deny the waiver is that it is based on a number of things. One of course being the nature of why the foriegn national was barred in the first place, or what crimes might have shown up in the checks. My fiancee has no criminal record and except for the overstay she has never done anything that would cause a problem.

My hardship letter is based on what we feel is very strong case.

1. I have minor daughter from previous marriage and my ex has signed a notorized document stating if take up residency overseas she will not allow my daughter to travel to visit me.

2. I have another daughter (unmarried with two children) that I provide some support for. She also signed a notorized document attesting to this.

3. I have 3 grandchildren that live locally with whom I have a close relationship and moving overseas would destroy that.

4. I have a very well paying job 100,000+ as a government employee in a field that I could not be hired by a foriegn company for 5 years, also because of the documented age discrimination for those individuals over 40 years of age I would never be able to match the income I now have.

5. Leaving my current job would forfeit my retirement.

6. I have large immediate family in US whereas she has only one brother in UK (I have a total of 6 children, all but one of whom are adults, however it would separate me from them. My parents are in mid 70s and while in reasonable health are not up to traveling and moving to UK would mean not seeing them near as much as I can now.

7. Her income is very low at this time with very little chance of it increasing to point that it would even come close to mine.

Okay after all that, my question is: Are denials on overstays (no deportation or involvement by government, she left of own accord) normally based on the strength of the hardship letters and documentations? Just curious as I have seen some denied lately but not sure of circumstances or strength of hardship letter.

Any opinions or information would be greatly appreciated.

Hi again. Looks like you have a strong hardship letter. I was just wondering if you or any of your family members might have a medical condition? Would you be providing assistance to your parents as they grow older? Is there anyone else to assist them. You might try to work that in there if possible.

As with an overstay or criminal basis for a waiver, I believe it boils down to the strength of the hardship letter and also the amount of time that has passed. I think with a 7 year overstay there is a 10 year bar so the more time that has passed since the bar was implemented the better.

Nigel's waiver was for an overstay but he doesn't post much on here anymore. You might try pm'ing him and he might answer some questions for you.

You might also try immigrate2us.net. They have an I-601 thread.

Well our overstay was for 7 years what they figured up. John does have a 10 year bar on him. Only about 1.5 years have passed. I think your hardships are extremely good...way better than ours were. You have children of your own and grandchildren I think that really helps. Also, you being a government worker your self I personally think that it will be in your favor. You are very much so headed in the right direction. Another thing they base the denial on is wether or not your fiance worked while being undocumented? I think they take that into deep consideration. These are just my opinions but thought it might help....
